The social benefits not collected by the person with a disability who has passed away, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until death, are paid to the surviving spouse, children, parents, or, in their absence, to the other heirs, according to common law, upon their request. The amounts provided above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general prescription period, based on the document certifying the status of heir, as well as, in cases where there are multiple heirs, a declaration on their own responsibility that the other heirs are not requesting these amounts.
