Procedure for granting educational incentive (social vouchers for kindergarten)*

Social tickets for kindergarten are granted within a national interest program that aims to increase access to education by stimulating participation in preschool education for children from disadvantaged families, the method of identifying beneficiaries being established by a decision of the Local Council.
The beneficiary of the incentive is the child, and the holder of the social ticket for kindergarten is the family representative, respectively the legal representative of the child.
The right to the incentive is granted starting from the month in which the beneficiary meets the eligibility criteria and is granted monthly during the period the child participates in activities organized in preschool education units, from September to June.
The funding for granting social tickets is provided from the state budget through amounts deducted from value-added tax, allocated for local budgets for this purpose.
Social tickets are issued only by units authorized by the Ministry of Public Finance. The operating authorization is granted according to the criteria established by the MFP, by order of the minister.
The holder may use the social ticket for kindergarten within the validity period, only for purchasing food products, hygiene products, clothing and/or stationery, exclusively from economic operators who sell the products provided by law and with whom the issuing unit has concluded specific service contracts for the social ticket sector.
The holder is prohibited:
  a) requesting and/or receiving any change from the social ticket for kindergarten if the amount corresponding to the requested products is less than the nominal value of the ticket;
  b) selling social tickets for kindergarten in exchange for money and/or other goods and/or services;
  c) using social tickets for kindergarten in stores, locations, units, markets of any kind that do not sell food, hygiene, clothing and/or stationery products and do not have the special stickers of the issuing unit displayed at the entrance;
  d) using social tickets for kindergarten to purchase products other than food, hygiene, clothing and/or stationery.
BENEFICIARIES OF THE TICKETS:
  1. children from disadvantaged families, Romanian citizens, who have domicile or residence in Romania;
  2. children from disadvantaged families, Romanian citizens, without domicile or residence and/or without housing, hereinafter referred to as homeless persons, only during the period they are registered with the public social assistance services at the administrative-territorial units where they live;
  3. children from disadvantaged families who do not have Romanian citizenship, if they are in one of the following situations: are citizens of a member state of the European Union, the European Economic Area, the Swiss Confederation or foreigners, hereinafter referred to as foreigners, during the period they have domicile or, where applicable, residence in Romania, in accordance with Romanian legislation; are foreign citizens or stateless persons who have been granted, under the law, a form of protection; are stateless persons who have domicile or, where applicable, residence in Romania, in accordance with the law. 
4. Disadvantaged families may consist of:
    a. husband, wife and their dependent children, living together;
c. unmarried man and woman, with their children and each of their own, living and managing a household together.
5. The following are considered to be part of the family
    a. the natural children of the spouses or of one of them or, as the case may be, of the single person;  
b. adopted children;
    c. children entrusted for adoption;
    d. children for whom the person has been designated for child maintenance;
    e. those placed or placed in emergency placement with a person or family or for whom guardianship has been established under the law, including those placed with a professional foster parent.

Documents and papers required for the preparation of the integration incentive file (according to Government Emergency Ordinance no. 111/2010)*

According to Government Emergency Ordinance (O.U.G.) 111/2010, the child-raising allowance until the age of 2 can be received, optionally, by either of the child's natural parents, if they have obtained for 12 consecutive or non-consecutive months in the last 24 months (prior to the child's birth) taxable professional income under the provisions of Law no. 571/2003, with its subsequent amendments and completions, namely: income from salaries, income from independent activities, income from agricultural activities, etc.

According to O.U.G. 111/2010 starting from January 1, 2011, persons who, in the last two years before the child's birth, have earned income for 12 months from salaries, independent activities, agricultural activities subject to income tax according to Law no. 571/2003 regarding the Fiscal Code, with its subsequent amendments and completions, hereinafter referred to as taxable income, may optionally benefit from the following rights:

a) parental leave for children up to 2 years old, as well as a monthly allowance - ICC

The monthly allowance provided in art.2, para. (1) letter a) of OUG 111/2010 is set at 85% of the average net income earned in the last 12 months and cannot be less than 1250 lei.

For a child with disabilities, parental leave is granted until the child reaches the age of 3, and the related allowance is granted at 85% of the average net income earned in the last 12 months and cannot be less than 1250 lei.

b) Monthly allowance for twin pregnancies – ICC2 = ICC1 +1250 lei

c) Insertion incentive is granted to persons who meet the conditions presented previously and for those who obtain taxable income according to art. 3, at least 60 days before the child reaches the age of 2, or 3 in the case of a child with disabilities, the granting of the insertion incentive is thus extended:

1) until the child reaches the age of 3;

2) until the child reaches the age of 4, in the case of a child with disabilities, without benefiting during this period from the provisions of art. 31 para. (1) and (2).

The amount of the insertion incentive is 650 lei.

Monitoring the way of growth and care of the child with parents gone to work abroad*

Monitoring the way of upbringing and care of the child with parents working abroad is addressed to children with both parents gone abroad, children with the single parent supporter gone abroad, children with one parent gone abroad, and children returned to the country after a period of staying abroad with their parents longer than one year.

After identifying the children in the above situation, monitoring is carried out through visits to their home or to the legal representatives to check the way they are cared for, identify risk situations, and those that require the provision of services and benefits.

Risk situations can be brought to the attention of the authority through direct request from the child or legal representative, notification from the parent who exercises sole parental authority, written or telephone report from other family members, self-reporting, case referral by a specialist or other institutions that interact with children/parents.

Parents will notify the institution regarding their intention to go to work abroad, indicating the person who will take care of the child’s upbringing and care during their absence.

Documents and papers required for the preparation of the state allowance file*

The state allowance is granted to all children up to 18 years old, Romanian citizens, as well as children who are foreign citizens and stateless persons, residents, under the conditions of the law, in Romania, if they live together with their parents.

In the case of young people who have reached the age of 18 and who are attending high school or vocational education courses organized under the conditions of the law, the state allowance is granted until their completion.

Monthly allowance for persons classified with severe disability with a personal assistant*

Persons classified as having a severe disability with a personal assistant are entitled to either the employment of a personal assistant paid by the local public authorities or to a monthly allowance.
The monthly allowance granted is equal to the net salary of a personal assistant, level 0, established according to the legal provisions governing the salary level of personnel paid from public funds.
The allowance is paid during the validity period of the disability certificate, issued by the child protection commissions or the adult disability assessment commissions, as applicable.
To benefit from the monthly allowance, the applicant must have domicile or residence in Paulesti commune.

Preparing the file for social assistance*

Beneficiaries:

a) families and single persons who have their domicile or, as the case may be, residence in Romania, with or without Romanian citizenship, as well as stateless persons;

b) families and single persons who do not have Romanian citizenship benefit from the provisions of Law no. 416/2001 if they are in one of the following situations:

- foreign citizens or stateless persons during the period they have domicile or, as the case may be, residence in Romania, under Romanian legislation;

- foreign citizens and stateless persons who have acquired, under the law, refugee status in Romania or who have been granted another form of protection provided by law.

c) in the case of spouses separated in fact, each of them benefits from the provisions of Law no. 416/2001, if they have declared different domiciles and if the conditions provided by this law are met.

It is granted based on an application and a declaration on own responsibility accompanied by supporting documents regarding the family composition and the income obtained in the month prior to the submission of the application by its members registered at A.S.S.C. Ploiesti. The situation is checked on site and the social inquiry is prepared for the purpose of granting/non-granting the social aid, following which the mayor's order is issued.

The monthly level of the guaranteed minimum income is: a)142 lei for a single person; b)255 lei for a family consisting of 2 persons; c)357 lei for families consisting of 3 persons; d)442 lei for families consisting of 4 persons;
e)527 lei for families consisting of 5 persons;

For each person over the number of 5 in the family, 36.5 lei is granted.

After processing the files and establishing the right, the Centralized Situation is drawn up monthly, including the beneficiaries and the amount of aid granted, which is forwarded to the County Agency for Payments and Social Inspection for payment to be made.

Necessary documents for preparing the file for child raising allowance*

According to Government Emergency Ordinance 111/2010, the child-raising allowance until the age of 2 may be received, optionally, by either of the child’s natural parents, if, in the last 24 months (prior to the birth of the child) they have obtained taxable professional income for at least 12 successive or consecutive months, according to the provisions of Law no. 571/2003, with its subsequent amendments and completions, namely: income from salaries, income from independent activities, income from agricultural activities, etc.

According to Government Emergency Ordinance 111/2010, starting with January 1st, 2011, persons who, in the two years prior to the birth of the child, have obtained for 12 months income from salaries, income from independent activities, income from agricultural activities taxable under Law no. 571/2003 regarding the Fiscal Code, with its subsequent amendments and completions, hereinafter referred to as taxable income, may optionally benefit from the following rights:

a) Leave for raising a child aged up to 2 years, as well as a monthly allowance - ICC

The monthly allowance provided for in art.2, para. (1) item a) of GEO 111/2010 is set at 85% of the average net income earned over the last 12 months and cannot be lower than 1250 lei.

For a child with a disability, the child-raising leave is granted until the child turns 3 years old, and the corresponding allowance is granted in the amount of 85% of the average net income earned over the last 12 months and cannot be less than 1250 lei.

b) Monthly allowance for multiple pregnancies – ICC2 = ICC1 + 1250 lei

c) Insertion incentive is granted to persons who fulfill the above-mentioned conditions and also to persons who obtain taxable income according to art. 3, at least 60 days before the child turns 2 years old, or 3 years old in the case of a child with disabilities, in which case the granting of the insertion incentive is extended as follows:

1) until the child turns 3 years old;

2) until the child turns 4 years old, in the case of a child with disabilities, without benefiting during this period from the provisions of art. 31 para. (1) and (2).

Minimum Inclusion Income*

Procedure description

Depending on the needs of the family/single person, the minimum inclusion income is accompanied by other complementary social assistance measures, granted in cash and/or in kind, as follows:
c) incentives;
d) contributory facilities;
e) other complementary rights
The minimum inclusion income consists of the total sums representing inclusion aid and aid for families with children, which are determined based on the adjusted net monthly income of the family within the following limits:
a) for inclusion aid, up to an adjusted net monthly income of 275 lei inclusive, which is considered when establishing the cumulative family income;
b) for inclusion aid, up to an adjusted net monthly income of 400 lei inclusive, which is considered when establishing the income of a single person aged at least 65 years;
c) for aid for families with children, up to an adjusted net monthly income of 700 lei inclusive.
The right is granted based on a self-declaration application, accompanied by supporting documents regarding the family composition, the income earned in the month prior to submitting the application by its members, and assets owned, including in other administrative-territorial units.
Case content:
- standard application;
- copies of the identity documents of all family members: husband/wife, children, partner;
- copy of the marriage certificate (if applicable);
- copy of the divorce decree (if applicable);
- copies of documents showing the status of guardian/curator, etc. (if applicable);
- copies of the decree of family placement/or adoption approval (if applicable);
- copy of the property/lease document for the housing;
- supporting documents regarding the income earned;
- income certificate issued by ANAF;
- certificate of fiscal attestation regarding assets owned;
- copies of documents showing inclusion in the category of people with disabilities (if applicable);
- other medical documents indicating incapacity for work;
- proof of school attendance by the dependent children.
