STANDARD REQUEST for the issuance of the operating permit, in which both the identification elements of the merchant will be entered: merchant name, registered office, CUI, registration number at the Trade Register Office, representative, address of the place of business for which the operating permit is requested, activities to be carried out at this place of business, proposed operating hours. This standard request is accompanied by documentation that includes documents established in correlation with the activity to be carried out at the place of business, in compliance with the relevant legislative provisions.*

The certificate of ascertainment regarding the activities carried out at the operational point, which is the subject of the request, issued by the Trade Register Office, contains strict information referring to the operational point and lists the activities that are actually carried out at the operational point. In the situation where this certificate of ascertainment includes activities that are not actually carried out at the operational point and for which no operating permit is requested, the administrator of the merchant shall submit a statement made on his own responsibility regarding the activities carried out at the operational point.*

The updated land register, not older than 90 days, of the property where the commercial activity or service provision takes place, with the registration of the corresponding function. The function registered in the land register must be in close correlation with the provisions of the approved urban planning regulations, in compliance with the classification of permitted uses according to categories of functions, in accordance with the local urban planning regulations in force. In the situation where the land register shows that the space in question is intended as a dwelling or has another purpose, but different in function from the one for which the operating agreement is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Department for the change of destination/function based on the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, shall be presented. In the situation where the commercial/service activity is to be carried out in a construction of a temporary and removable nature, for which there is a building permit, such as a kiosk, booth, or stall or other similar ones (for commercial activity), located on private land (except those located on the public or private domain of the municipality), the updated land register of the land on which it is located, not older than 90 days, shall be presented, if it is not possible to present a land register with the registration of this construction. A land register excerpt will NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*

Traders who do not own the space related to the work point to be authorized shall submit, in addition to the documents mentioned in the previous point, any deed/contract by which the lease is regulated in their favor. If this lease regulation deed is not for an indefinite period, it is considered that the authorization request is made for a limited period, within the validity of the lease.*

The written agreement of the co-owners - co-dividers (where applicable) will be given with the specification of the identification data of the signatories, namely the identity document and personal numeric code*

The situation plan showing the location of the building where the commercial or service activity is carried out: situation plans taken from the internet are also valid.*

A photograph of the facade of the sales structure will be presented, showing its access.*

The plan targeted for non-change shall be presented as an annex to the building permit corresponding to the sales structure space or the survey of the space in question.*

It is a standard form that includes information regarding the sales structure.*

The fire safety authorization or denial issued by the competent authority Inspectorate for Emergency Situations "Avram Iancu" of Cluj county.*

Environmental permit issued by the Cluj Environmental Agency for the activities included in annex 4 to HCL 851/2017 (see regulatory acts)*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure being authorized.*

A copy of the building permit/subscription for the occupation of public domain with access roads, valid, will be presented in the situation where access to the sales structure subject to authorization is made through distinct arrangements on the public domain, other than those corresponding to public alleys. In the case where the sales structure does not have an access road, a declaration made on the trader's own responsibility will be submitted.*

Proof of ownership of private land necessary for parking spaces: for 1 vehicle for every 80 sqm of usable area related to the sales structure within which car maintenance and repair activities are carried out.*
