The operating permit issued under the conditions of this procedure allows traders, natural or legal persons authorized under the law, to carry out auto maintenance and repair activities. These activities are performed with reference to the auto maintenance and repair activities provided in the annex to Ordinance no. 99/2000 regarding the marketing of market products and services, republished, as well as other incident regulatory normative acts.

In order to obtain the operating permit, the trader will address the City Hall of Cluj-Napoca by submitting an application, Form D - STANDARD APPLICATION for the issuance of the operating permit, in which both the trader’s identification details will be entered: trader name, registered office, CUI, registration number at the Trade Registry Office, representative, as well as the address of the workplace for which the operating permit is requested, the activities to be carried out at this workplace, and the proposed operating schedule.

This standard application is accompanied by documentation that includes documents determined in correlation with the activity/activities to be carried out at the workplace, in compliance with the relevant legislative provisions. The structure responsible for the application is the Patrimony and Property Records Directorate, Trade Authorization Service.

In the situation where this certificate of ascertainment includes activities that are not actually carried out at the operational point and for which no operating permit is requested, the administrator of the merchant shall submit a statement made on his own responsibility regarding the activities carried out at the operational point.*

The function registered in the land register must be in close correlation with the provisions of the approved urban planning regulations, in compliance with the classification of permitted uses according to categories of functions, in accordance with the local urban planning regulations in force. In the situation where the land register shows that the space in question is intended as a dwelling or has another purpose, but different in function from the one for which the operating agreement is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Department for the change of destination/function based on the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, shall be presented. In the situation where the commercial/service activity is to be carried out in a construction of a temporary and removable nature, for which there is a building permit, such as a kiosk, booth, or stall or other similar ones (for commercial activity), located on private land (except those located on the public or private domain of the municipality), the updated land register of the land on which it is located, not older than 90 days, shall be presented, if it is not possible to present a land register with the registration of this construction. A land register excerpt will NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*
