Before addressing indisputable administrative court, the person who considers himself/herself harmed in a right of his/hers or in a legitimate interest, through a unilateral administrative act, must request from the issuing public authority, within 30 days from the date of communication of the act, the revocation, in whole or in part, of this act. The complaint can be addressed equally to the superior hierarchical body, if it exists.

The person harmed in a right recognized by law or in a legitimate interest, through a unilateral administrative act, dissatisfied with the response received to the prior complaint addressed to the issuing public authority or if he/she has not received any response within the term provided in art. 7 para. (4), may notify the competent administrative litigation court, in order to request the annulment, in whole or in part, of the act, the repair of the damage caused, and, possibly, reparations for moral damages. Also, the administrative litigation court may be addressed by the person who considers himself/herself harmed in a right of his/hers, recognized by law, through failure to resolve in time or through the unjustified refusal to resolve the request.
