Request for license for the public sanitation service of localities or for one or more specific activities of this service, provided in the form of direct management by commercial companies with the status of regional operators - https://www.anrsc.ro/gestiune-directa-salubrizare/

Resolution time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a letter informing them of the obligation to make additions, corrections, or clarifications, referring to the application and submitted documents, within 30 days from the registration of the documentation.

In case, within 30 days from the date of the request letter for additions, the applicant does not provide all the corresponding documentation required by the regulations, including the requested additions, A.N.R.S.C. will return the corresponding documentation, cancelling the respective request from the license granting procedure, communicating this decision to the applicant.

Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) to summon, at the A.N.R.S.C. headquarters, authorized representatives of the applicant to clarify certain aspects that arise/do not arise from the submitted documentation;

b) to conduct on-site verification of the accuracy of the data from the documentation submitted by the applicant.

A.N.R.S.C., through its specialized department, prepares a technical report that includes the justified proposal for granting/rejecting the license and which will be presented for analysis to the Licensing Commission by the secretary of the commission.

The proposal to grant/reject the license is subject to a vote within the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C..

In the case of license granting, A.N.R.S.C. communicates to the applicant the fiscal invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date the invoice is communicated.

After payment confirmation, A.N.R.S.C. sends the applicant within a maximum of 5 days, the order of the A.N.R.S.C. president for granting the license accompanied by the license and conditions associated with it.

In case of non-compliance with the 30 days term for payment of the license granting fee, A.N.R.S.C. will proceed with the withdrawal of the license.

In case of refusal to grant the license, A.N.R.S.C. sends the applicant within a maximum of 5 days from issuance, the order of the A.N.R.S.C. president for the rejection of the license accompanied by the reasons for the refusal.

For the case in which the granting of the license was refused, the applicant may not submit new licensing documentation earlier than 6 months from the date of issuing the order of rejection.

Final document:

a) Order granting the license, accompanied by the license and conditions associated with the license;

b) Order rejecting the license, accompanied by the reasons for the refusal;

c) Notification regarding the cancellation of the request from procedure.

Notification deadline upon expiration of the resolution time: 5 days from the date of confirmation of payment of the license granting fee, in case of granting the license, respectively 5 days from the date of issuing the order of rejection.
