Social benefits remaining uncollected by the deceased person with disabilities, representing the indemnity and/or the complementary personal budget for the month in which the death occurred, and, as the case may be, the social benefits due and unpaid until death, are paid to the surviving spouse, children, parents or, in their absence, to the other heirs, under the conditions of common law, upon their request. The amounts provided above may be requested from the territorial agency for payments and social inspection by the heir, within the general limitation period, based on the document attesting the quality of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs are not requesting these amounts.
