This procedure regulates the manner of organizing the activity of receiving citizens in audience at the Bistrița-Năsăud County Council.

Request for issuance of certificate requested by former employees of the Bistrița-Năsăud County Council within 3 years from the termination of the employment relationship/individual employment contract*

This procedure regulates the way of submitting online requests by persons whose mandate/service relationship/individual employment contract/management contract with the local public authority - Bistrița-Năsăud County Council ended 3 years ago, for the purpose of issuing the requested certificates to attest a right or a fact, namely the period of activity carried out within the authority, the duration of the activity, length of service, seniority in the specialty of studies, seniority in professional grade, and monthly salary.

Specifications
According to art. 7 para.(6) of Government Decision no. 905/2017 regarding the general register of employees, the deadline for resolving the request is:
”(6) Upon the written request of the employee or a former employee, employers are obliged to issue them an extract from the register, dated and certified for conformity, or a certificate attesting the activity performed by them, the duration of the activity, salary, length of service, and in the specialty, as shown in the register and in the personal file, within no more than 15 days from the date of the request.”
The same resolution deadline will apply to persons who have been appointed to public positions during the service relationship with the Bistrița-Năsăud County Council, based on the provisions of art. 367 of Government Emergency Ordinance no. 57/2019 regarding the Administrative Code, with subsequent amendments and completions.

Type of electronic signature
Qualified electronic signature is understood as an advanced electronic signature that is created by a qualified electronic signature creation device and is based on a qualified certificate for electronic signatures according to the definitions provided in art. 3 of EU Regulation no. 910/2014 of the European Parliament and of the Council of 23 July 2014 regarding electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC. The type of electronic signature applicable by natural or legal persons for requests submitted online through the PCUe platform is the qualified electronic signature. If the applicant does not have a qualified electronic signature, the request shall be sent in original by post or submitted directly to the registry of the Bistrița-Năsăud County Council.

Request for issuance of certificate from the archive of Bistrița-Năsăud County Council*

This procedure regulates the method of transmitting online requests for issuance of certificates from the archive of the Bistrița-Năsăud County Council, according to the provisions of Art. 29 of the National Archives Law No. 16/1996, republished, Art. 44 of the Instructions regarding archive activities at document creators and holders, approved by the leadership of the National Archives through Day Order No. 217/1996 and Art. 3 of Government Ordinance No. 33/2002 regarding the regulation of issuing certificates and attestations by central and local public authorities.

Clarifications

The resolution deadline according to Art. 8 para (1) of Government Ordinance No. 27/2002 regarding the regulation of petition resolution activities, with subsequent amendments and completions is: "The signaled authorities and public institutions are obliged to communicate to the petitioner, within 30 days from the registration date of the petition, the response, regardless of whether the solution is favorable or unfavorable."


Qualified electronic signature is understood as an advanced electronic signature which is created by a qualified electronic signature creation device and which is based on a qualified certificate for electronic signatures according to definitions provided in Art. 3 of EU Regulation No. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC.
The type of electronic signature applicable by individuals or legal entities for online requests is the qualified electronic signature.
If the applicant does not hold a qualified electronic signature, the documents will be issued only after receiving the original request by mail or directly at the registry of the Bistrița-Năsăud County Council. Request for public interest information according to the provisions of Law no. 544/2001 regarding free access to public interest information*

This procedure regulates the way of submitting online requests for information of public interest, according to the provisions of Law no. 544/2001 regarding free access to information of public interest, within the Bistrița-Năsăud County Council.

Clarifications:

The deadlines for resolution according to Law no. 544/2001 regarding free access to information of public interest can be found in ART.7:

"(1) Public authorities and institutions are obliged to respond in writing to requests for public interest information within 10 days or, as the case may be, within at most 30 days from the registration of the request, depending on the difficulty, complexity, volume of documentary work and urgency of the request. If the time required for identifying and disseminating the requested information exceeds 10 days, the response will be communicated to the applicant within a maximum of 30 days, provided that he/she is notified in writing about this within 10 days.
(2) The refusal to communicate the requested information must be justified and communicated within 5 days from the actually receiving of the petitions.
The costs related to recommend services for copying the requested documents (if copies in written format are requested) can be paid: -in cash, by bank settlement, by bank cards and by other payment systems, according to the legal provisions in transfers. The account to which the payment will be made is: RO89TREZ10121160250XXXXX.

The copying fee established according to the Decision of Bistrița-Năsăud County Council no. 148 from 19.12.2019 regarding the rates for identifying and issuing copies of documents created and managed by the Bistrița-Năsăud County Council, for the year 2020, is as follows:

- Simple copy of the documents created and managed by the institution:
A4 format - 1 lei/page;
A3 format - 2 lei/page;

- Copies matching the inscription after the documents created and managed by the institution on which the stamp "certified true to the original" has been applied
A4 format - 2 lei/page;
A3 format - 3 lei/page;

The rates for copying with the copier other documents that require larger sizes will be based on the A4 format, for which the multiplied area of the A4 format will be calculated and collected.

Submit petition*

This procedure regulates the method of online submission of petitions addressed to the Bistrița-Năsăud County Council, according to the provisions of Government Ordinance no. 27/2002 regarding the regulation of the activity of resolving petitions, with subsequent amendments and completions.

Petition means the request, complaint, notification, or proposal submitted in writing or by electronic mail, which a citizen or a legally established organization may address to central and local public authorities and institutions, decentralized public services of ministries and other central bodies, national companies and societies, commercial companies of county or local interest, as well as autonomous administrations, hereinafter referred to as public authorities and institutions according to art.2 of Government Ordinance no. 27/2002 regarding the regulation of the activity of resolving petitions, with subsequent amendments and completions.

Notes:

Resolution deadlines according to art.8 and art.9 of Government Ordinance no. 27/2002 regarding the regulation of the activity of resolving petitions, approved by Law no. 233/2002, with subsequent amendments, are:

“Art.8 (1) The notified public authorities and institutions are obliged to communicate the response to the petitioner, within 30 days from the date the petition is registered, regardless of whether the decision is favorable or unfavorable.

(2) For resolving petitions transmitted, according to art. 61, from other authorities or public institutions, the 30-day deadline starts from the date the petition is registered at the competent authority or public institution.

Art.9 In the case where the aspects reported in the petition require more detailed information and investigation, the head of the authority or public institution may extend the deadline provided in art. 8 by no more than 15 days, and in the energy and natural gas sector, the deadline may be extended by no more than 30 days, with prior notification of the petitioner.”

Request regarding the completion of the internship within the bachelor’s or master's degree programs*

This procedure regulates the method for online submission of requests regarding the completion of internships within bachelor's or master's degree programs according to Order no. 3955/2008 of the Ministry of Education, Research, and Youth regarding the approval of the General Framework for the Organization of Internships within Bachelor's and Master's Degree Programs and the Framework Agreement regarding the completion of internships within bachelor's or master's degree programs, within the Bistrița-Năsăud County Council.


Clarifications

The deadlines for resolution according to art.8 para.(1) and art.9 of Government Ordinance no. 27/2002 regarding regulation of the activity of solving petitions, amended and supplemented by Law no. 233/2002 for the approval of Government Ordinance no. 27/2002 regarding breakage of the petition solving activity are: “art.8(1) The notified public authorities and institutions have the obligation to communicate to the petitioner, within 30 days from the date of registration of the petition, the response, regardless of whether the solution is favorable or unfavorable. art.9 In the situation where the issues raised by the petition require a more thorough investigation, the head of the authority or public institution may extend the period provided for in art. 8 by no more than 15 days.”

Submission of recommendations according to Law no.52/2003*

This procedure regulates the method of submitting proposals/suggestions/opinions of a recommendation nature regarding normative acts subject to public consultation, by using online services within the "Single Electronic Contact Point" (PCUe) platform in the National Electronic e-Government System.

Clarifications

In accordance with the provisions of art.7 para.(1) of Law no.52/2003, in the procedures for drafting normative act projects, the Bistrița-Năsăud County Council is obliged to publish an announcement regarding this action on its website, display it at its headquarters in a space accessible to the public, and send it to the local media, as appropriate.

When publishing the announcement, a period of at least 10 calendar days is set to receive proposals, suggestions, or opinions regarding the normative act projects subject to public consultation.

The proposal, suggestion, or opinion (hereinafter referred to as recommendation) regarding the draft normative act subject to public debate is recorded in a register, mentioning the date of receipt, the person, and the contact details from whom the recommendation was received.

Interested persons/organizations submitting recommendations regarding the draft normative act subject to public debate must specify the article or articles in the draft normative act to which they refer, mentioning the date of submission and the sender's contact details.

Request for issuance of copies of documents held in the archive of the Bistrița-Năsăud County Council*

This procedure regulates the method of submitting online requests for the issuance of copies of documents held in the archives of the Bistrița-Năsăud County Council, according to the provisions of art. 29 of the National Archives Law no. 16/1996, republished, and art. 44 of the Instructions regarding the archival activity at creators and holders of documents, approved by the management of the National Archives through Order of the Day no. 217/1996.

Resolution period according to Art. 8 para.(1) of the Government Ordinance no. 27/2002 regarding the regulation of petition settlement activity, with subsequent amendments and additions, is: “The notified public authorities and institutions are obliged to communicate to the petitioner, within 30 days from the registration date of the petition, the answer, regardless of whether the solution is favorable or unfavorable.”

Applicable fees
The costs related to the copying services of requested documents (if copies are requested in written format) can be paid: in cash, by bank transfer, by bank cards, and through other payment systems, according to the legal provisions in force. The duplication fee established according to Decision of the Bistrița-Năsăud County Council no. 148 of 19.12.2019 regarding the rates for identifying and issuing copies of documents created and managed by the Bistrița-Năsăud County Council, for the year 2020, is as follows:

- Simple copy of documents created and managed by the institution:
  • A4 format - 1 leu/page;
  • A3 format - 2 lei/page;

- Certified true copies of documents created and managed by the institution, bearing the “certified copy” stamp
  • A4 format - 2 lei/page;
  • A3 format - 3 lei/page;

The rates for copying other documents requiring larger sizes will be based on the A4 format, compared to which the multiplied area of the A4 format will be calculated and collected.

Qualified electronic signature means an advanced electronic signature that is created by a qualified electronic signature creation device and which is based on a qualified certificate for electronic signatures according to the definitions provided in art. 3 of Regulation (EU) No. 910/2014 of the European Parliament and Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC.

The type of electronic signature applicable by natural or legal persons for requests submitted online through the PCUe platform is the advanced electronic signature.

In the situation where it is requested to issue copies of documents from the professional files kept in the county council’s archive, the type of electronic signature applicable for requests submitted online is the qualified electronic signature.


If the applicant does not possess a qualified electronic signature, the documents will be issued only after receiving the original application by mail or directly at the Registry of the Bistrița-Năsăud County Council.
