Botosani Pharmacists' College*

The transfer note is issued by the college where the pharmacist is registered, based on a request. Before the transfer note is issued, the pharmacist requesting it is obliged to pay up to date the contribution owed to the college from which they wish to leave. The transfer note will be handed, with a signature, to the applicant. In the register of pharmacists, the college to which the pharmacist has transferred will be mentioned. If a complaint against the pharmacist has been registered at the college from which the pharmacist is transferring or a disciplinary investigation has been initiated, the complaint or disciplinary file will be forwarded to the college to which the pharmacist is transferring.

DECISION

Regarding the Current Professional Certificate, we wish to make the following clarifications:
for the amendment of the Decision of the National Council of the College of Pharmacists of Romania
no. 1/2007 regarding the drafting and issuance of the current professional certificate

Based on art. 589 letter c) of Law no. 95/2006 regarding health sector reform, republished, with subsequent amendments and completions, as well as art. 2 para. (2) and art. 15 of the Rules regarding the drafting, issuance, and use of evidence of honorability and professional morality for doctors,
dentists and pharmacists, approved by Government Decision no. 1.464/2006, the National Council of the College of Pharmacists of Romania d e c i d e s:
Article I
The Decision of the National Council of the College of Pharmacists of Romania no. 1/2007 regarding the drafting and issuance of the current professional certificate, published in the Official Gazette of Romania, Part I, no. 324 of May 15, 2007, as amended, is hereby amended as follows:
1. In Article 3, paragraph (2) shall have the following wording:
(2) Within a maximum of 10 calendar days from receipt of the application, the College of Pharmacists of Romania will draft the current professional certificate and send it to the territorial college.
2. Article 4 shall have the following wording:
Article 4
To obtain the current professional certificate, the pharmacist shall submit or send electronically to the territorial college to which they belong the standard application, as well as the following documents if they have not already been submitted and registered with the respective territorial college:
a) copy of the bachelor's degree;
b) copy of the membership certificate of the College of Pharmacists of Romania;
c) copy of the identity document, applicant's passport, other identity documents;
d) copy of documents regarding obtained specializations;
e) proof of payment of the certificate issuance fee.
3. In Article 5, paragraph (2) is repealed.
4. Annexes no. 2 and 3 are repealed.
Article II
This decision enters into force on January 1, 2024.
Article III
This decision shall be published in the Official Gazette of Romania, Part I.

In accordance with the provisions of Pharmacy Law no. 266/2008 in the consolidated form as published in O.G. no. 448/30.06.2009 part I, as well as the Rules of Application published in O.G. no. 538/03.07.2009 part I, pharmacists who will hold the position of chief pharmacist in a pharmaceutical unit (in cases of establishment of new pharmaceutical units, as well as changes of chief pharmacist — for those who will take over the chief position), must address the county colleges to obtain the Current Professional Certificate.

The methodology for drafting and issuing the Current Professional Certificate was established by Decision of the National Council of the C.F.R. no. 1/2007, decision published in the Official Gazette of Romania Part I no. 324 of 15.05.2007.

We present below the main provisions of Decision no. 1/2007, as follows:

- The Current Professional Certificate will be drafted by the College of Pharmacists of Romania and issued by the territorial college where the applicant is registered;

- The validity of the Current Professional Certificate is 3 months from the date of issue;

- Within a maximum of three days from receiving the request for issuance of the Current Professional Certificate, the territorial college will send to the College of Pharmacists of Romania the standard request for drafting and issuance of the document;

- Within a maximum of 30 days from receipt of the request, the C.F.R. will draft the certificate and send it to the territorial college;

- The Current Professional Certificate will be issued by the College of Pharmacists of Romania, which will prepare it and send it to the territorial college;

- The territorial college will draft a Register of records – with the identification data of the Current Professional Certificates issued to pharmacists in that county – and will hand them to applicants with a receipt signature.

The fee for issuance of the Current Professional Certificate, in the amount of 150 lei, will be paid to the account of the territorial College.

Resumption of member status is done based on a request, which the applicant, the pharmacist, submits at the headquarters of the Territorial College, respectively the College of Pharmacists Botosani, through which they request the resumption of member status starting from a certain date.

The membership certificate is granted to pharmacists who, by making an express request in this regard, meet the following conditions:

- hold an official qualification title in pharmacy,

- are not found in any cases of unworthiness or incompatibility provided by law,

- are medically fit to practice the profession of pharmacist, - have not interrupted the practice of the profession for more than 5 years or have obtained a bachelor's degree in the last 5 years,

- have paid the registration fee - amounting to 10% of the minimum wage.

• Ch. I Exercise of the pharmacist profession,

• Ch. II Provisions regarding the exercise of the pharmacist profession on the territory of Romania by pharmacists who are citizens of an EU member state, a state belonging to the EEA or the Swiss Confederation

According to:

Art. 563 - The profession of pharmacist is exercised on the territory of Romania, under the conditions of this law, by natural persons holding an official qualification in pharmacy, as follows:

a) citizens of the Romanian state;

b) citizens of a EU member state, a state belonging to the EEA or the Swiss Confederation;

c) spouse of a Romanian citizen, as well as direct descendants and ascendants supported by a Romanian citizen, regardless of their citizenship;

d) family members of a citizen of one of the states provided in lett. b), as defined by art. 2 para. (1) point 3 of the Government Emergency Ordinance no. 102/2005 regarding free movement on the territory of Romania of citizens of the EU and EEA member states and citizens of the Swiss Confederation, republished, with subsequent amendments and completions;

e) citizens of third states who are beneficiaries of the status of permanent resident in Romania;

f) beneficiaries of the status of long-term resident granted by one of the states provided in lett. b).

2. For pharmacists who are citizens of third countries

Required documents:

• The address issued by the Ministry of Education and Research – National Center for Recognition and Equivalence of Diplomas (CNRED) recommending the completion of a traineeship in a public or hospital pharmacy, agreed upon by the College of Pharmacists of Romania;

• The certificate of completion of the full traineeship, in a public or hospital pharmacy;

• Copy of the bachelor's degree;

• Copy of identity document;

• Traineeship logbook stamped and signed by the Territorial College, where the pharmacy in which the traineeship was performed is located.

3. Verification of language skills

According to Art. 585^1*):

(4) The College of Pharmacists of Romania may conduct the verification of language skills only after the issuance, according to EU norms, of the European professional card for pharmacists or, as the case may be, only after the recognition of the professional qualification of the pharmacist concerned.

In assessing language skills, the College of Pharmacists of Romania will consider the duration of the activity that is to be performed.

Proof of language skills may be provided by a certificate of language proficiency.

Suspension of membership is done when the applicant, the pharmacist, for certain reasons wishes to interrupt their activity for a certain period of time and submits to the territorial College headquarters a request asking for the suspension of their membership. At the moment the suspension is requested, the pharmacist must have paid the membership fee until the end of the year and must meet the condition of continuous professional training through a number of 40 EFC hours for that period. In support of the request, the following documents listed below must also be attached:

The pharmacist is obliged to inform the College of Pharmacists of Romania within 30 days of resuming activity.

In order to proceed with the issuance of a duplicate Certificate of membership of the College of Pharmacists of Romania, the applicant must submit the complete documentation to the headquarters of the College of Pharmacists Botosani, in accordance with the provisions of Decision no. 4/2004 of the National Council of the College of Pharmacists of Romania.
