(1) Persons who, in the last 2 years prior to the date of the child's birth, have obtained for at least 12 months income from salaries and salary-assimilated incomes, income from independent activities, income from agricultural activities, forestry, and fisheries, subject to income tax according to the provisions of Law no. 227/2015 regarding the Fiscal Code, with subsequent amendments and supplements, hereinafter referred to as taxable income, are entitled to childcare leave for children up to 2 years of age, or 3 years in the case of a child with a disability, as well as to a monthly allowance."

(1) Persons who, during the period in which they are entitled to benefit from child-raising leave as provided in Article 2 paragraph (1), obtain income subject to tax according to Article 3, have the right to an insertion incentive in the monthly amount of 50% of the minimum indemnity established in Article 2 paragraph (2).
