Issuance of certificate of status*

The service involves issuing certificates that confirm the registrations from the agricultural register, necessary for preparing scholarship, unemployment, social assistance files, for population records, and for various institutions (Electrica, Eon Gaz, mobile telephony, etc.).

Certificates can be requested by any person who is registered in the Agricultural Register.

  • those citizens who do not have a position in the agricultural register will fill out a declaration on their own responsibility that they do not own agricultural land within the city of Negreşti nor in other localities in the country, which they will attach to the application
  • for social assistance and unemployment certificates, no fiscal stamp is required with the application
  • for certificates required for population records, it is mandatory for the applicant to have a position in the agricultural register (to own agricultural land, house, and annexes).

Registration in the Agricultural Register*

Any natural or legal person who owns or leases agricultural land, forest land, animals, birds, and bees, or by legal persons whose main activity is animal breeding or land cultivation within the territory of Negrești city.

The request can be made by the head of the household or any other adult family member.

The person who wishes to register in the Agricultural Register must present themselves at the agricultural register office with supporting documents in order to be entered in the agricultural register.

This procedure regulates the method of submitting online requests for issuing a certificate from the archive of the Negresti Town Hall, according to the provisions of art. 29 of the National Archives Law no. 16/1996, republished, art. 44 of the Instructions regarding archival activity for document creators and holders, approved by the management of the National Archives by Daily Order no. 217/1996, and art. 3 of Government Ordinance no. 33/2002 regarding the regulation of the issuance of certificates and attestations by central and local public authorities.

Urbanism - Request for Urbanism Certificate*

According to the specifications regarding the completion of the “Request for issuance of the urban planning certificate” form, the main element for identifying the property is the postal address, completed with the topographical or cadastral plan, as applicable, and in its absence, with any other available identification elements (as mentioned in the specifications attached to the request).

IMPORTANT! The Urban Planning Certificate does not replace the building/demolition permit and does not confer the right to carry out construction works.

Urbanism - Request for Extension of Urbanism Certificate*

For the extension of the validity of the urbanism certificate, a standard application form must be completed and submitted to the issuer (according to Form - model F.7 - APPLICATION for the extension of the validity of the urbanism certificate), accompanied by the original issued urbanism certificate. The application for the extension of the validity of the urbanism certificate must be submitted 15 days before the expiration of its validity date.
When submitting the application for the extension of the validity of the urbanism certificate, the applicant must provide proof of payment for the extension fee.

The conditions for issuing the tax attestation certificates are provided by Law no. 227/2015 regarding the Fiscal Code and by Law no. 207/2015 regarding the Fiscal Procedure Code. Issuance of notice/operating permit for carrying out commercial activities*

Economic operators carrying sop commercial activities, service provision, and public catering activities (corresponding to the CAEN codes provided in the Annex) are obliged to submit documentation in order to obtain the operating agreement, respectively the operating license for carrying out public catering activities.

It is not necessary to obtain the operating license in the following situations:

  • for the headquarters of the economic operator where only office activity is carried out without involving public access, except in cases where authorization is expressly requested, justified by the requirement of a legislative act (e.g. organization of auctions, courses, bank loans, etc);
  • for the work points of legal persons with non-profit purpose (associations, foundations, etc) who do not carry out commercial or service provision activities;
  • for food and non-food product manufacturing activities that are carried out in industrial areas provided for in the Urban Zoning Plan (P.U.Z.) and which do not involve the sale of products through own sales structures;
  • for spaces with an exclusive profile of gambling and betting;
  • for law offices, headquarters of public notaries, judicial executors, judicial liquidators, mediators, accounting experts;
  • for medical offices, medical analysis laboratories and medical clinics;
  • for financial intermediation activities (currency exchange, insurance, etc);
  • for other forms of legal organization that operate under special laws.

Request for the producer's certificate*

The producer certificate and the marketing permit for products from the agricultural sector can be requested by any person who is registered in the Agricultural Register and who is a producer of vegetables, fruits, flowers or animal products.

Obtaining the necessary approval for the sale of agricultural land outside the built-up area*

The necessary approval for the alienation of agricultural land outside city limits can be requested by any person who owns agricultural land outside city limits, for the purpose of selling.

Posting the sale offer

Within one working day from the registration of the request, the sale offer will be posted for 30 days at the Negreşti Town Hall and on the town hall's website.
Within 3 working days from the registration of the sale request, the Agricultural Registry Office will prepare the list of preemptors, which will be posted at the town hall and on the website.

Acceptance of the sale offer

During the 30-day period from the posting of the sale offer, the Public Relations Department will register all communications regarding the acceptance of the land sale offer (model ANNEX 1D), submitted by any of the preemptors, accompanied by the following documents:

- copy of CI/BI for the preemptor who is a natural person;
- copy of certificate of incorporation from ORC in the case of the preemptor who is a legal entity;
- notarized copies of supporting documents certifying the status of preemptor (co-ownership documents, lease contract, ownership documents of properties that have a common border with the land being sold, etc.)

Selection of the preemptor as the potential buyer

The seller's decision regarding the selection of the preemptor as the potential buyer will be registered at the Public Relations Office
Within 3 working days from its registration, the Agricultural Registry Office will notify, as appropriate, M.A.D.R. or D.A.D.R. MM with the name and identification details of the chosen preemptor, potential buyer.
The final approval necessary for the conclusion of the sale contract in authentic form by the public notary will be issued, as appropriate, by M.A.D.R. or D.A.D.R. MM.

Non-exercise of the right of preemption

If no preemptor communicates acceptance of the seller's offer and the sale is free, the Agricultural Registry Office will issue the seller a certificate attesting that all procedural steps regarding the exercise of the right of preemption have been completed and that the land is free for sale at the price specified in the sale offer. The certificate will be accompanied by a certified copy of the sale offer, conforming to the original.
