Procedure regarding the cancellation of the tourism license and/or the appendix of the tourism license for the branch/subsidiary/representative/secondary office of a travel agency*

In the case of the permanent cessation of activity in the travel agency and/or in its branch/subsidiary/representative office/secondary office, the economic operator shall request the cancellation of the tourism license and/or the annex to the tourism license at least 30 days before the permanent cessation of activity. For this purpose, the following documentation will be submitted to the headquarters of the central public institution responsible for tourism (see Necessary Documents): (1) The documentation submitted by the applicant is analyzed and settled as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism shall inform the applicant, within 5 working days from the date of registration of the application, by a notification, regarding the need to submit additional documents, as well as the consequences on the time limit for analyzing the documentation provided for in paragraph (1); (3) If within 45 days from the date of issuance of the first notification the documentation provided for in paragraph (2) is not completed, it will be closed.

Procedure regarding the homologation of ski slopes and routes for approval*

The economic operator submits to the headquarters of the central public authority responsible in the field of tourism an application accompanied by the documentation provided for in opacity 1 of OMT no. 491/2001. The homologation of ski slopes for leisure is carried out by the central public authority responsible in the field of tourism based on the findings made on site by a commission composed of representatives of this authority as well as representatives of county councils. The commission carries out its activity with the consultation of representatives of professional associations in the field and of the local council within whose territorial area the ski slope or the ski route submitted for homologation is located. The homologation request must be made at least 45 days before the opening of the slopes. The verification of the documentation is carried out within 5 days from the date of registration, and if necessary, an address for completion will be issued in case the documentation is incomplete. Within 30 days from the date of registration of the complete documentation, the certificate of homologation is issued, if the minimum homologation criteria are met.

Procedure regarding the issuance of the tourism license annex for the tour operator/intermediary travel agency*

For the issuance of the tourism license annex for its secondary office, the economic operator holding a tourism license for a tour operator/intermediary agency submits to the headquarters of the central public authority responsible for tourism a documentation with the following content (see below, Required documents). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public authority responsible for tourism informs the applicant, within 5 working days from the date of registration of the request, by means of a notification, regarding the need to submit additional documents, as well as the consequences regarding the documentation analysis deadline provided in paragraph (1); (3) If within 45 days from the date of issuing the first notification the documentation provided in paragraph (2) is not completed, it will be filed.

The procedure regarding the issuance of the tourism license and, as the case may be, of the annex to the tourism license for the branch/secondary office/representative office thereof, in the case of changing the type of tourism agency*

Procedure regarding the issuance of the tourism license and, where applicable, the annex(es) to the tourism license in the case of a change in the name of the organizing/intermediary travel agency*

For the issuance of the tourism license and, if applicable, the annex to the tourism license for its secondary office, in the event of a change in the name of the tour operator/intermediary travel agency, the economic operator shall submit the following documentation to the headquarters of the central public institution responsible in the field of tourism (see below, the Required Documents section). Procedure for notifying the central public institution for tourism regarding the temporary and occasional provision of the profession of tourist guide on the territory of Romania*

This procedure applies exclusively to providers who travel to Romania for the purpose of practicing, on a temporary and occasional basis, the profession of tourist guide. The temporary and occasional nature of the provision of services is evaluated on a case-by-case basis, especially according to the duration of the service, its frequency, periodicity, and continuity. When the provider travels for the first time from a member state to Romania to provide services, the central public authority for downtourism must be informed in advance, by means of a written declaration that includes information regarding insurance coverage or other means of personal or collective protection regarding professional liability.

The declaration is renewed once a year if the provider intends to provide services, temporarily or occasionally, in Romania during that year. For the first provision of services or in the case of a material change regarding the situation established in the documents, the provider shall submit to the central authority for tourism the aforementioned declaration, which will be accompanied by the documents listed in the section "Required documents".

Procedure regarding the issuance of the tourism license*

In order to obtain the tourism license, the individual submits to the headquarters of the central public institution responsible in the field of tourism the necessary documentation provided in Chapter IX General provisions regarding the conditions and criteria for issuing the tourism license from Order 65/2013 with subsequent amendments and additions.

The applicant's request is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its submission together with the complete documentation. In the case of incomplete documentation, the central public institution responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the application, through a notification, regarding the need to submit additional documents, as well as the consequences on the provided documentation analysis term. If within 6 months from the date of issuance of the notification, the required documentation is not complete, it will be filed.

Procedure for issuing the classification certificate for natural persons*

The economic operator, a natural person owner of tourist accommodation structures such as apartments and/or rooms for rent in family homes, submits a standardized application at the headquarters of the central public authority responsible for tourism to obtain the classification certificate (see Required Documents) accompanied by the documentation provided in the annex to the ANT President's Order no. 65/2013 for the approval of the methodological norms.
Within a maximum of 30 days from the date of registration of the complete documentation, a Provisional Operating Authorization is issued for the unit type and requested classification category, granting the economic operator the right to operate until the on-site verification of the respective tourist accommodation structure. In case of incomplete documentation, the central public authority responsible for tourism shall inform the applicant, within 5 working days from the registration of the application, through a notification, regarding the need to submit additional documents, as well as the consequences on the previously stipulated documentation review deadline. If within 6 months (180 days) from the date the notification is issued the documentation is not completed, it is filed. The on-site verification of the tourist accommodation structure is carried out within 90 days from the date of issuing the Provisional Operating Authorization and a Classification Note is prepared.
If at the date of the on-site verification minor deficiencies are found which can be remedied as a matter of urgency, the commission may grant a short remediation period of maximum 7 working days, making mention in the classification note regarding these aspects. The economic operator is required, after remedying the deficiencies, without exceeding the granted period, to provide proof of remedying the deficiencies by submitting supporting documents.
The issuance of the classification certificate for the tourist accommodation structure and the sheet regarding the nominal classification of accommodation spaces by category and type and/or the sheet regarding the nominal classification of spaces in tourist accommodation structures with public food service functions, is done within 15 days from the preparation date of the Classification Note.

The procedure for issuing certificates and travel guides badges for individuals who fulfill the conditions and criteria provided by the legislation in force to exercise the tourism guide profession

The issuance of the tourism guide certificate and badge is carried out by the central public authority responsible in the field of tourism, at the request of the applicant, based on the application accompanied by the documentation provided by OMTCT no. 637/2004. Within a maximum of 30 days from the date of registration of the complete documentation, the certificate and badge of tourism guide are issued in the name of the applicant.

Procedure regarding the tourist authorization of nautical leisure activity*

The economic operator submits to the headquarters of the central public authority responsible in the field of tourism, the application accompanied by the documentation stipulated by OMTCT no. 292 of 2003.

The verification of the documentation is carried out within 5 days from the date of registration, and if necessary, an address for its completion will be drafted in case it is incomplete.

Within 30 days from the date of registration of the economic operator’s application, the nautical recreational area is verified and the tourism authorization certificate is issued only if the conditions regarding the arrangement, equipment, and endowment of the nautical recreational area are met.

Procedure regarding the issuance of classification certificates for tourist accommodation and/or catering establishments*

The economic operator submits to the headquarters of the central public authority responsible in the field of tourism a standardized request for obtaining the classification certificate (see Required Documents) accompanied by the documentation provided in the annex of the Order of the president of ANT no. 65/2013 for the approval of methodological norms.

Within a maximum of 30 days from the date of registration of the complete documentation, a Provisional Operating Authorization is issued for the type of unit and the requested classification category, granting the economic operator the right to operate until the on-site verification of the concerned tourist reception structure. In the case of incomplete documentation, the central public authority responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the request, through a notification, regarding the need to submit additional documents, as well as the consequences regarding the previously stated documentation analysis term. If within 6 months (180 days) from the date the notification is issued, the documentation is not completed, it is archived. On-site verification of the tourist reception structure is carried out within 90 days from the issuance date of the Provisional Operating Authorization, and a Classification Note is prepared.

If at the date of on-site verification minor deficiencies are found that can be remedied urgently, the commission may grant a short remediation period of maximum 7 working days, mentioning these aspects in the classification note. The economic operator is obliged, after remediation of the deficiencies and without exceeding the granted term, to prove the remediation of deficiencies by submitting supporting documents.

The issuance of the classification certificate for the tourist reception structure and the record sheet regarding the nominal classification of accommodation spaces by categories and types and/or the record sheet regarding the nominal classification of spaces in tourist reception structures with public catering functions is carried out within 15 days from the date the Classification Note is prepared.

Procedure regarding the reclassification of units to another type of tourist accommodation structure and/or classification category*

If there have been changes regarding the fulfillment of the conditions that formed the basis for the issuance of the classification certificate, the economic operator owner and/or administrator of a tourist accommodation structure is required to request a new classification of the accommodation structure in question, within 30 days from the occurrence of the changes. Within a maximum of 30 days from the date of registration of the complete documentation, a Provisional Operating Authorization is issued for the requested type of unit and classification category, granting the economic operator the right to operate until the on-site verification of the tourist accommodation structure in question. In the case of incomplete documentation, the central public institution responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the application, by notification, of the need to submit additional documents, as well as the consequences on the previously provided documentation review period. If, within 6 months (180 days) from the date of the notification, the documentation is not completed, it will be closed.

The on-site verification of the tourist accommodation structure is carried out within 90 days from the date of issuance of the Provisional Operating Authorization and the Classification Note is drawn up.

If, on the date of the on-site verification, minor deficiencies that can be remedied as a matter of urgency are found, the commission may grant a short period for rectification of up to 7 working days, making mention of these aspects in the classification note. The economic operator is required, after remedying the deficiencies, without exceeding the granted period, to prove the rectification of deficiencies by submitting supporting documents.

The issuance of the Classification Certificate for the tourist accommodation structure and the sheet regarding the nominal classification of accommodation spaces by categories and types and/or the sheet regarding the nominal classification of spaces within the tourist accommodation structures with public catering functions is carried out within 15 days from the date of drawing up the Classification Note.

Procedure regarding the issuance of the preliminary operating permit for tourist accommodation structures with recreational facilities in tourist resorts*

Economic operators carrying out recreational activities in tourist resorts are required to apply for a prior approval before obtaining the operating permit issued by the town halls.

The documentation is verified within 5 days from the registration date, and if necessary, a request for completion will be drafted if it is incomplete.

Within 30 days from the date of registration of the complete documentation, the prior approval is issued if the conditions provided in art. 2 of GD 511/2011 are met.

Procedure regarding the accreditation of national information and tourist promotion centers*

The local or county council – as appropriate – under whose authority the National Center for Tourism Information and Promotion operates, requests the issuance of the accreditation certificate from the central public institution responsible in the field of tourism, with documentation containing the specifics indicated in the Required Documents section.

The accreditation documentation is checked for compliance with the accreditation criteria and the accreditation certificate is prepared, according to the model shown in the Final Documents section. The issuance of the accreditation certificate is done within a maximum of 30 days from the date of registration of the complete documentation. If the National Center for Tourism Information and Promotion does not meet all the criteria to be accredited, the interested local or county council, as appropriate, will be informed in writing, within the same period. In case of incomplete documentation, the central public institution responsible in the field of tourism will inform the applicant regarding the necessity to submit the missing documents. If, within 180 days from the date of informing the applicant, the documentation is not completed, it will be archived.

Procedure for the recognition of the professional qualification of tour guide obtained in an EU/EEA/Swiss Confederation member state*

EU/EEA/Swiss Confederation citizens who settle in Romania and wish to practice the occupation of tourist guide are required to obtain the tourist guide certificate and badge, according to the documentation for the recognition of professional qualifications obtained in an EU/EEA/Swiss Confederation member state. The applicant will submit to the central public tourism authority the application provided in Annex no. 2 of OMEAT no. 180/2023i, accompanied by the documents listed in the "Required documents" section.

Procedure regarding the authorization of beaches for tourism purposes*

The requesting economic operator, called the beach user, who has concluded a lease contract with the National Administration Romanian Waters, submits to the headquarters of the central public authority responsible in the field of tourism the application accompanied by the documentation provided by OMDRT no. 1204 of 2010. The documentation is checked within 5 days from the date of registration, and if necessary, a request for completion will be drawn up if it is incomplete. Within 15 days from the date of registration of the beach user's application, the on-site verification of the fulfillment of the mandatory and optional criteria is carried out by the staff of the Ministry of Tourism, and the result of the verification is recorded in the tourist authorization note for the beach. Within 30 days from the date of registration of the complete documentation, the tourist authorization for the beach is issued.

AUTHORIZATION OF ECONOMIC OPERATORS ESTABLISHED IN EU / EEA MEMBER STATES , AUTHORIZED TO PROVIDE SPECIFIC SERVICES OF TRAVEL AGENCIES IN THEIR STATE OF ESTABLISHMENT WHICH INTENDS TO PROVIDE CROSS- BORDERS SERVICES

In case of cross-border provision of tourism services, the economic operators established in other Member States of the European Union or the European Economic Area, can provide specific services of travel agencies based on the authorization / license or equivalent documents issued by the Member State of origin and just notifies the Romanian central public authority responsible for tourism. Cross-border provision is determined under the temporary and occasional provision being established especially by: duration, frequency, regularity and continuity of supply.

Procedure regarding the issuance of a duplicate classification certificate/attachment sheet for accommodation/public catering tourist reception structures*

In case of loss or damage/destruction of the classification certificate, the economic operator, holder of the classification certificate/annex sheet, requests the issuance of a duplicate classification certificate/annex sheet.

Within a maximum of 30 days from the date of registration of the complete documentation, a new classification certificate and/or a new annex sheet will be issued, according to the request of the economic operator.

In the event of the cessation of activity of the tourist accommodation structure, the economic operator owner and/or administrator of the respective tourist accommodation structure has the obligation to request the cancellation of the classification certificate and to return the original classification certificate and the annex sheet/sheets, by mail with acknowledgment of receipt or by submitting them at the registry office of the central public administration authority responsible for tourism.

Procedure regarding the change of the certificate holder of classification for tourist accommodation/public catering structures*

The on-site verification of the tourist accommodation structure is carried out within 90 days from the date of issuance of the Provisional Operating Authorization, and the Classification Note is prepared.

If, on the date of the on-site verification, minor deficiencies are found that can be remedied urgently, the commission may grant a short remediation period of a maximum of 7 working days, making mention of these aspects in the classification note. The economic operator is obliged, after remedying the deficiencies, without exceeding the granted period, to provide proof of remedying the deficiencies by submitting supporting documents.

The issuance of the Classification Certificate for the tourist accommodation structure and of the form regarding the nominal classification of accommodation spaces by category and type and/or the form regarding the nominal classification of spaces in the catering function tourist accommodation structures is carried out within 15 days from the date of preparation of the Classification Note.

Procedure regarding the renewal of the tourism license*

In case there have been changes regarding the fulfillment of the criteria for granting the tourism license that would allow a person, according to the legislation in force, to obtain a tourism license for a higher position, the holder of the tourism license may request the exchange of the tourism license. In this situation, holders of tourism licenses previously issued for the positions of: chalet keeper, travel agency manager, hotel manager or restaurant manager who meet the criteria for issuing the tourism license for the position of manager in tourism activity may do so. In the case of a name change as a result of marriage, the tourism license is not exchanged. In order to obtain the tourism license, the natural person submits to the headquarters of the central public institution responsible in the field of tourism, a documentation with the content specified in the "Required documents" section.

The applicant's request is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its submission accompanied by the complete documentation. Procedure for closing a secondary office of the tour operator/intermediary travel agency or for opening a new secondary office of the tour operator/intermediary travel agency*

For the issuance of the annex to the tourism license for the secondary office, in the case of the closure or establishment of a secondary office, the economic operator submits to the central public institution responsible for tourism a documentation with the following content (see below, the Necessary Documents section). (1) The documentation submitted by the applicant is analyzed and resolved as quickly as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant, within 5 working days from the date of registration of the request, by notification, regarding the need to submit additional documents, as well as regarding the consequences on the analysis period of the documentation stipulated in para. (1); (3) If within 45 days from the date the first notification is issued, the documentation provided in para. (2) is not completed, it is closed.

Procedure regarding the modification of the annex sheet of the classification certificate for tourist accommodation/food service structures*

In the event that modifications have occurred in the structure of spaces with accommodation and/or public catering functions, the economic operator owner and/or administrator of the tourist reception structures shall submit the documentation for the issuance of a new annex sheet within 30 days from the occurrence of the modifications.

If in the new structure of spaces with accommodation functions there are also spaces classified in a higher classification category, the economic operator shall mention, through a justificatory memorandum for reclassification, the minimum mandatory criteria regarding the area and utilities actually fulfilled in those respective spaces, compared to the comfort grade (category) entered in the classification certificate.
Within a maximum of 30 days from the date of registration of the complete documentation, a new annex sheet is issued, according to the economic operator's request.

In the case of incomplete documentation the central public institution responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the application, by a notification, regarding the need to send additional documents, as well as regarding the consequences on the review period of the documentation provided above. If within 6 months (180 days) from the date of issuance of the notification, the documentation is not completed, it is closed.

Procedure for submitting the Statement regarding the activity carried out by the organizing travel agencies*

The declaration is to be filled out by the economic operator holding a valid tourism license for organizing activities, issued under the specific legislation in force by the central public authority responsible in the field of tourism, by completing a form, in accordance with the obligations provided by art. 19 of the Government Ordinance no. 2/2018 regarding packages of travel services and associated travel services, as well as for amending certain normative acts. The declaration is to be submitted monthly, no later than the 15th (inclusive) of the following month, by the economic operator owner/administrator of the organizing travel agency, according to the legal provisions in force. The declaration is to be sent as an EXCEL file with the extension .P7M/.P7S, by electronic means - using the PCUe platform, in accordance with the filling instructions and requirements imposed by the provisions of O.M.T. no. 1.183 of October 10, 2018 for approving the template, content, method of submission and management of the 'Declaration regarding the activity carried out by the organizing travel agencies', as subsequently amended. To submit the declaration, the economic operator must hold a qualified certificate, issued under the conditions of Law no. 455/2001 on electronic signature, republished.

European Professional Card (EPC) for the profession of mountain guide in Romania*

The European Professional Card is an electronic certificate that certifies either that the professional has met all the requirements necessary to provide temporary and occasional services in a host Member State, or the recognition of professional qualifications for establishment in a host Member State.
The holder of the mountain guide qualification may choose to apply for such a card either by applying the procedure regarding the temporary and occasional provision of the tourist guide profession in Romania, or by the procedure for recognition of professional qualifications based on Law no. 200/2004 regarding the recognition of professional qualifications with subsequent amendments and completions, as applicable.
To facilitate the free movement of mountain guides within the EU, the European Commission, under Regulation 983/2015 regarding the procedure for issuing the European Professional Card and the application of the alert mechanism pursuant to Directive 2005/36/EC of the European Parliament and Council, provided for the introduction of the European Professional Card (EPC) for mountain guides. The EPC is valid indefinitely if you establish yourself long-term or for 12 months if you provide temporary services.
To obtain the EPC, interested persons will access the Your Europe portal ("Europa Ta") where all documents required by the competent authority from each Member State are published and will create an account on the ECAS platform.   • Each required document (copies of originals, copies of certified translations, etc.) must be uploaded as a single PDF file containing all page(s) of the document;
  • For each uploaded document, the applicant must complete the identification information and address of each issuing authority;
  • All submitted documents will be validated as authentic and valid by the Internal Market Information System (IMI) by the competent authority in the Member State of origin (according to EPC Regulation 2015/983).

The central public authority in the field of tourism (Tourism Department within the Ministry of Economy, Energy and Business Environment) is the competent authority for issuing the EPC for mountain guides wishing to establish themselves in Romania for the purpose of exercising this profession.

List of regulated professions in Romania: The profession of mountain guide is included in the category of specialized tourist guides for certain segments of tourism services; the tourist guide profession is regulated in Romania and is found in the List of regulated professions - Annex no. 2 of Law no. 200/2004 regarding the recognition of professional qualifications with subsequent amendments and completions.

FEES: No fees are charged for issuing the EPC.

The procedure for approving technical documentation regarding constructions in the field of tourism*

The local public authority or the interested natural or legal person requests the central public institution responsible in the field of tourism to issue the approval based on documentation with the following content (see Required documents);.


The approval is issued for:
1. Technical documentation regarding the location, configuration and functionality of new constructions with tourist destination such as:
a) tourist accommodation structures:
- hotel, apartment-hotel, motel, villa, bungalow, cabin, holiday village, camping, guesthouse with a capacity of more than 3 rooms, regardless of their comfort category;
b) dining structures:
- classic restaurant, specialized restaurant, restaurant with national or local specific, brasserie, beerhouse, summer garden, bars of any type, fast food units - self-service restaurant, "express" buffet, pizzeria, snack-bar-confectionery, pastry shop, organized in:
* units arranged in special spaces intended for this purpose, included in tourist accommodation structures;
* independent structures, located within tourist resorts;
c) tourist leisure structures:
- clubs, casinos, multipurpose halls, facilities and equipment specific to tourist recreation - cable car tourist transport, ski slopes and similar;
d) spa treatment structures:
- spa tourism complexes (according to Ordinance no. 58/1998: buildings that include in the same building or in physically or functionally connected buildings tourist accommodation structures (accommodation, dining and spa treatment, possibly leisure);
2. documentation regarding the specific functionality of existing constructions in the field of tourism, subject to modernization, refurbishment, extension or other works that modify their tourist function;
3. documentation regarding constructions to be structurally and functionally modified for the purpose of acquiring a tourist function.
(1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration;
(2) In the case of incomplete documentation, the central public institution responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the request, by notification, regarding the academic rhe need to submit additional documents, as well as regarding the consequences on the documentation analysis period stipulated in para. (1);
(3) If within 60 days from the date of issuing the notification, the documentation provided in macro paragraph (2) is not completed, it shall be closed.
