Procedure regarding the settlement of the value of medicines*

In accordance with the provisions of the Order of the Minister of National Defense no. M 110/2009 – Instructions regarding medical and pharmaceutical assistance in the Ministry of National Defense during peacetime, with subsequent amendments and completions, the following categories of persons benefit from medical assistance and medication within S.M.U. Constanța:
a) active military personnel;
b) volunteer soldiers and rank-and-file, including during the training period;
c) pupils and students of military educational institutions;
d) reserve servicemen during recall or mobilization, regardless of rank, only for the period of recall;
e) family members of active military personnel*);
f) reserve and retired military personnel, military pensioners;
g) family members of reserve and retired military personnel;
h) military personnel retired due to disability as a result of service accidents or illnesses contracted during and due to fulfilling military obligations who later opted for the state social security pension;
i) civil servants and contract civilian staff of the Ministry of National Defense (civilian personnel);
j) war veterans, widows and invalids, as well as other categories of persons provided for by special laws;
k) other categories of persons, under the conditions of the law.
*) By family members of active military personnel is meant the spouse, children and parents who are legally dependent on them (art. 112 of Law no. 80/1995 regarding the status of military personnel, with subsequent amendments and completions).
From the budget of the Ministry of National Defense, the personal co-payment for compensated pharmaceuticals and the value of medications not included in the compensated lists are covered for the categories of persons provided in art. 4 letters a) - f), h) and j).
The reimbursement of medication prescribed on simple prescriptions is made with the cumulative fulfillment of the following conditions:
a) prescribed medications are not provided free of charge through national health programs;
b) prescribed medications are not included in the lists of compensated or free medications.
Depending on the medical services available at S.M.U. Constanța, according to the normative acts in force, the following are ensured:
1) primary medical and health promotion services, early detection of diseases;
2) specialty outpatient and inpatient medical services;
3) dental medical services;
4) emergency medical services;
5) health recovery-rehabilitation medical services (kinesiotherapy);
6) medico-military expertise.
The categories of persons provided in letters a) - g) benefit from reimbursement of the personal contribution for the medical services established by the normative acts in force, from the budgetary funds of the Ministry of National Defense.
The categories of persons provided in letters e) - h) and j) benefit free of charge from the medical services provided at points 1) - 5) listed above, under the conditions provided by law.
The persons provided in letter i) benefit from reimbursement of medical services rendered from the budget of the Ministry of National Defense, only if the condition has arisen as a result of a work accident or an occupational disease.
The persons provided in letter k) benefit from medical assistance within S.M.U. Constanța, in accordance with the legal provisions in force.

Procedure regarding the provision of copies of medical documents for patients*

The procedure aims to regulate the specific conditions for issuing medical documents requested by patients / relatives / authorized persons as well as the conditions for transmitting the patient's medical data.
The issuance of medical documents requested by patients / relatives / authorized persons is carried out in strict accordance with the provisions of OMS 1410/2016 regarding the approval of the Norms for the application of the Law on patient rights no. 46/2003, following compliance with the following rules:
a) The request regarding the communication of personal medical data is addressed by patients / relatives / authorized persons, in writing, by filling in the "Request for communication of personal medical documents" form, provided in annex no. 3 to OMS 1410/2016. This form is approved by the hospital commander and is forwarded to twice B.R.S.M. for resolution.
b) In the case of minors, adults without discernment, and adults with temporary loss of exercise sopacity, the applicant must prove that they are a relative / legal representative.
c) In the case of authorized persons requesting medical documents of patients, they must attach the "Patient's consent regarding the communication of medical data" as provided in annex no. 5 to OMS 1410/2016.
d) The issuance of copies of the requested medical documents is made by the person designated by the head of B.R.S.M. together with the archival fund manager, within 30 calendar days from registration at the institution’s headquarters.
e) The issuance of copies of the requested medical documents is done after the patients / relatives / authorized persons complete the "Declaration regarding the communication of personal medical documents" form, provided in annex no. 4 to OMS 1410/2016.
The regulation of the process of issuing medical documents requested by patients/relatives/authorized persons or other persons, entitled to access to information, according to the law, has the following main purposes:
a) The patient has unrestricted access to personal medical data, under the conditions of the law. The patient's access to medical data may be direct or indirect – through legal relatives or through doctors designated by them in Annex no. 5 to the norms “Patient's consent regarding the communication of personal medical data” (Law 46/2003 updated).
b) All information regarding the patient's condition, investigation results, diagnosis, treatment, personal data are confidential, even after the patient’s death. This information may only be provided if the patient gives explicit consent or if the law expressly requires it. If the information is needed by other accredited medical service providers involved in treating the patient, consent is no longer mandatory. (Law 46/2003 updated).
