In compliance with the Order of the Ministry of Transport and Infrastructure no. 980 of 2011, the Romanian Road Transport Authority - ARR is the public institution that issues the transport operators the license for activities related to public road transport - transport intermediary activities. The license is issued for the economic operators (EO) who comply with the following conditions: an effective and stable establishment in a Member State; appropriate financial standing, professional competence, good repute, in compliance with the art. 126 of the Ministry of Transport and Infrastructure nr. 980 of 2011. In case the EO owns working places /branches where he/she performs intermediary activities of public road transport, shall request for each of them a license for activities related to public road transport.

The documents that prove that EO deals with activities related to public road transport-intermediary activities with the commercial code no 5229, according to the respective legal form of organization, as follows: the Registration Certificate of the Chamber of Commerce and the Article of Association for the commercial companies or the Registration Certificate of the Chamber of Commerce and authorization for performing independent economic activities for authorized natural persons, individual and family enterprises or the Article of Association, the fiscal code and the proof of the registration with the Register of associations and foundations, in case of the non-profit foundations and associations with legal personality or the Article of Association, the fiscal code and the Regulation on the organization of the company for other institutions/authorities, besides the ones above mentioned

An affidavit shall be submitted, as referred to in Appendix 6 of the Order of Ministry of Transport and Infrastructure no. 980/2011 in order to prove they were not sanctioned for the infringements stipulated by art. 6, paragraph 1, sub-paragraphs a) and b) of the Regulation CE no 1071 of 2009, or a document similar to the criminal record issued by a judicial or administrative authority of the member state where the transport manager have the normal residence. This document is not accepted in case it is not submitted within 3 months from the issue date.
