Necessary documents for issuing the certificate with data from the national register of persons' records.
According to Law no.677/2001—for the protection of individuals regarding the processing of personal data and the free movement of such data—the general rules for processing personal data, the rights of targeted individuals, and the obligations of operators are established. This law protects the private and family life of citizens.
Personal data means any information regarding an identified or identifiable individual (name and surname, home or residence address, birth date, data from civil status documents, BI/CI series and number, personal numeric code)
Individuals or legal entities may request, based on written motivated requests, the communication of personal data from the National Register of Persons' Records, regarding civil status data, identity documents, domiciles and residences, and the assigned personal numeric code.
In the situation where an individual requests the transmission of personal data through an individual law office, a written request for this must be formulated and submitted for competent resolution to the community public persons' records service within whose jurisdiction the individual whose data is being requested resides.
According to normative acts, the provision of some personal data can only be done after obtaining, in advance, the written consent of the targeted individuals (through which they declare expressly and unequivocally whether they agree or not with the provision of the requested data).
The consent of the targeted persons is not necessary when there is a justified legal basis.
Requests for personal data received from police authorities, the Ministry of Defense, the Romanian Intelligence Service, the Prosecutor’s Office, Justice, specialized social protection institutions regarding minors or other persons entitled to protection, individuals whose legitimate interests are proven by documents demonstrating the justified legal basis, individuals requesting communication of their own data from the persons’ records, etc., are considered justified legal grounds.
