STANDARD REQUEST for issuing the operating permit, in which the identification elements of the merchant will be entered: merchant name, registered office, CUI, registration number at the Trade Register Office, representative, address of the workplace for which the operating permit is requested, activities that will be carried out at this workplace, proposed operating schedule. This standard request is accompanied by documentation comprising documents established in correlation with the activity to be carried out at the workplace, in compliance with the applicable legislative provisions.*

The certificate of findings regarding the activities carried out at the work point that is the subject of the request, issued by the Office of the Trade Register, contains strict information related to the work point and lists the activities that are actually carried out at the work point. In the situation where this certificate of findings includes activities that are not actually carried out at the work point and for which an operating permit is not requested, the administrator of the merchant will present a declaration made on his own responsibility regarding the activities carried out at the work point.*

The updated land register, not older than 90 days, of the property where the commercial activity or service provision takes place, with the corresponding function registered. The function entered in the land register must be in close correlation with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, according to the Local Urban Planning Regulation in force. In the situation where the space in question is registered in the land register as residential or with another destination, but different in function from the one for which the operating agreement is requested, the urbanism certificate and the notices/agreements mentioned therein / the construction authorization, as applicable, issued by the Urbanism Directorate for the change of destination/function must be presented, based on the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions. In the situation where the commercial/service activity is to be carried out in a temporary and removable construction, for which there is a building permit, such as a kiosk, booth, or stand or other similar (for commercial activity), located on private property (except those located on the public or private domain of the municipality), the updated land register of the land on which it is located, not older than 90 days, must be presented, if it is not possible to present a land register with the registration of this construction. An excerpt from the land register shall NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*

Traders who do not own the space related to the workplace to be authorized will submit, in addition to the documents mentioned in the previous point, any document/contract regulating the lease in their favor. If this lease regulation document is not for an indefinite period, it is considered that the authorization request is made for a limited period, within the validity of the lease.*

The written agreement of the co-owners - coindivisors (where applicable) shall be given with the specification of the identification data of the signatories, namely the identity document and personal identification number.*

The site plan showing the location of the property where the commercial or service activity takes place: site plans taken from the internet are also valid.*

A photograph of the sales structure façade will be presented, showing the access to it.*

The plan targeted for non-change will be presented as an annex to the building permit related to the sales structure space or the survey of the space in question.*

It is a standard form that includes information regarding the sales structure.*

It will be presented by food service units within the accommodation structures and those managed by tourism companies, regardless of location.*

Authorization regarding fire safety or negative issued by the authorized authority Inspectorate for Emergency Situations "Avram Iancu" of Cluj County.*

Declaration on own responsibility regarding the exact number of seats at tables, respectively the total number of persons that can be accommodated within the premises of the sales structure in question. It will be formulated on own responsibility by the representative of the merchant.*

Declaration regarding classification by types of the public food unit in the context of public food activities: the declaration provided in annex no. 2 to HG no. 843/1999 shall be completed.*

Environmental permit issued by the Cluj Environmental Agency for the activities included in annex 4 to HCL 851/2017 (see normative acts)*

Certification of compliance with hygiene and public health standards, issued by the Cluj Public Health Directorate, for the activities included in Annex 5 to HCL 851/2017 (see normative acts)*

The act issued by the Sanitary-Veterinary Directorate of Cluj County for the activities included in annex 6 to HCL 851/2017 (see normative acts)*

The certificate of completion of the hygiene courses or the graduation diploma from a high school with an economic profile will be presented, for the employed staff.*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure to be authorized.*

Merchants who carry out public catering activities (CAEN code 561 and 563) or recreational and entertainment activities (CAEN code 932) at the sales structure and request operating hours after 22:00, will also present, in this regard, the approval of the Cluj-Napoca Municipal Police for operation according to the requested schedule based on the relevant legislation.*

A copy of the building permit/subscription for occupying the public domain with access roads, valid, shall be presented in situations where access to the sales structure subject to authorization is made via distinct arrangements built on public domain, other than those corresponding to public walkways. If the sales structure does not have an access road, a statement shall be submitted, made under the trader’s own responsibility.*
