By way of exception from the procedure provided under letters A and B, under the conditions of art. 24 para. (7) of GEO no. 86/2006, citizens of a member state of the European Union or of the European Economic Area, including citizens belonging to the Swiss Confederation, who have acquired the status of insolvency practitioner in one of these states, may temporarily or occasionally practice the profession of insolvency practitioner. The temporary exercise of the activity consists in carrying out the activity for a limited period of time that must be indicated by the applicant. Occasional exercise means carrying out the activity of insolvency practitioner for a single debtor from the opening of the proceedings until their closure.

The profession of "practitioner in reorganization and liquidation", commonly known as "insolvency practitioner", is found in Annex no. 2 of Law no. 200 of 2004 regarding the recognition of diplomas and professional qualifications for regulated professions in Romania, with subsequent amendments and completions.*

According to Art. 32 of GEO 86/2006 regarding the organization of the activity of insolvency practitioners: The decisions of the management bodies of UNPIR to reject the requests submitted pursuant to art. 30 para. (2), as well as the requests for registration for the exam to acquire the status of practitioner must be duly justified and may be challenged before the competent court, in accordance with the procedure provided by the Administrative Litigation Law no. 554/2004, as subsequently amended and supplemented.
