Social benefits remaining uncollected by the deceased person with disabilities, representing the indemnity and/or complementary personal budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until death shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, under common law conditions, upon their request. The amounts mentioned above may be claimed at the territorial agency for payments and social inspection by the heir, within the general prescription period, based on the document certifying heir status, as well as, in the situation where there are several heirs, a declaration on their own responsibility that the other heirs do not request these amounts.
