The registration of a patent application with OSIM is not mandatory and is subject to a fee, the tax regime being established by Government Ordinance no. 41/1998, regarding the fees in the field of industrial property protection and the regime for their use, with subsequent amendments and completions. The standard “Patent Application” form must be completed in 3 copies, accompanied by the respective documents consisting of: summary, description, drawings (if applicable), claims. These may be submitted online, by mail or at the OSIM headquarters. The examination of a patent application is done in accordance with the provisions of Law 64/1991 regarding invention patents, with subsequent amendments and completions, as well as the Implementing Regulation, provided the legal fees are paid. Public registers can be consulted here, and OSIM decisions are subject to appeal.
