The operating permit issued under the conditions of this procedure allows traders, natural or legal persons authorized according to the law, to carry out retail/en detail activities, cash and carry, ambulant type, and service provision activities (other than public catering, recreational and entertaining activities, as well as maintenance and repair of motor vehicles).
These activities are exercised with reference to food products, non-food products, and market services (other than public catering, recreational and entertaining activities, as well as maintenance and repair of motor vehicles) and which are provided in the annex to Ordinance no. 99/2000 regarding the commercialization of products and market services, republished, as well as other applicable regulatory acts.
To obtain the operating permit, the trader will address the Cluj-Napoca City Hall by submitting an application - Form A - STANDARD REQUEST for issuing the operating permit, in which both the identification elements of the trader will be included: trader name, registered office, fiscal identification code (CUI), registration number at the Trade Registry Office, representative, as well as the address of the work point for which the operating permit is requested, the activities to be carried out at this work point, proposed operating schedule. This standard request is accompanied by documentation that includes documents established in correlation with the activity/activities to be carried out at the work point, in compliance with the applicable legal provisions. The structure handling the application is the Municipal Heritage and Property Records Directorate, Trade Authorization Service.

In the case where the commercial/service activity is to be carried out in a provisional and removable construction, for which there is a construction permit, such as a kiosk, booth, or stall or similar (for commercial activity), located on private property (except for those located on public or private property of the municipality), the updated land register of the land on which it is located will be presented, not older than 90 days, if it is not possible to present a land register with the entry of this construction. An excerpt from the land register will NOT be presented in the case of spaces with another destination that are the object of lease contracts with the local public administration authority.*
