License application for the public lighting service, provided under the direct management method by companies with fully public capital - https://www.anrsc.ro/gestiune-directa-iluminat-public/

Resolution time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities operator of the requested completions by A.N.R.S.C.

Procedure description : The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a letter informing the obligation to make additions, corrections or clarifications, with reference to the application and the submitted documents, within 30 days from the registration of the documentation.

In the event that, within 30 days from the date of the request for additions, the applicant does not provide all the documentation required by the regulations, including the requested additions, A.N.R.S.C. will return to him the related documentation, removing the respective application from the license granting procedure, communicating this decision to the applicant.

Depending on the way of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the A.N.R.S.C. headquarters, the applicant’s authorized representatives, to clarify certain aspects that arise/do not arise from the documentation provided;

b) on-site verification of the authenticity of the data from the documentation sent by the applicant.

A.N.R.S.C., through the specialized department, draws up a specialized report that includes the reasoned proposal for granting/rejection of the license and which will be presented for analysis to the Licensing Commission, by the secretary of the commission.

The proposal to grant/reject the license is submitted to vote within the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C..

In case of granting the license, A.N.R.S.C. sends the applicant the tax invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date of communication of the invoice.

After confirmation of payment, A.N.R.S.C. transmits to the applicant in maximum 5 days, the order of the president of A.N.R.S.C. for granting the license, accompanied by the license and the associated conditions.

In case of not fulfilling the 30-day term for payment of the license granting fee, A.N.R.S.C. will proceed to withdraw the license.

In case of refusal to grant the license, A.N.R.S.C. sends to the applicant within maximum 5 days from issuance, the order of the president of A.N.R.S.C. of rejection of the license accompanied by the reasons for refusal.

For the situation where the license granting has been rejected, the applicant can no longer submit a new licensing documentation earlier than 6 months from the date of issuance of the rejection order.

Final document:

a) License granting order, accompanied by the license and the conditions associated with the license;

b) Order of rejection of the license, accompanied by the reasons for refusing the granting;

c) Notification regarding the removal of the application from the procedure.

Notification term at the expiration of the resolution term: 5 days from the date of confirmation of the payment of the license granting fee, in the case of granting the license, respectively 5 days from the date of issuing the order for refusing the license.
