The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until the time of death, shall be paid to the surviving spouse, children, parents or, in their absence, to the other heirs, according to common law, upon their request. The amounts provided above can be requested from the territorial agency for payments and social inspection by the heir, within the general limitation period, based on the document certifying the status of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not request these amounts.
