Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, if applicable, social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, under the conditions of common law, upon their request. The amounts provided above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general statute of limitation, based on the document certifying heir status, as well as, in the case where there are several heirs, a declaration on their own responsibility stating that the other heirs do not request these amounts.
