Social benefits left uncollected by the deceased person with disabilities, representing the indemnity and/or the complementary personal budget for the month in which the death occurred, and, as applicable, the social benefits due and unpaid until death are paid to the surviving spouse, children, parents, or, in their absence, to the other heirs, under common law conditions, at their request. The amounts mentioned above can be requested at the territorial agency for social payments and inspection by the heir, within the general limitation period, based on the document attesting their status as an heir, and, if there are several heirs, the declaration on their own responsibility that the other heirs do not request these amounts.
