The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, as the case may be, the social benefits owed and unpaid until the death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, under common law at their request. The amounts provided above may be claimed at the territorial agency for payments and social inspection by the heir within the general statute of limitations, based on the document certifying heir status, as well as, in case there are several heirs, a declaration on their own responsibility that the other heirs do not claim these amounts.
