Acquiring signature right_Rom. arch._OAR non-members_Rom. diploma_5-year exper. An architect has the right to participate in the interview for awarding the signature right without having completed his professional traineeship if he can prove having an experience in architectural design of minimum 5 years from the date of acquiring the architect title. The interview shall be held with the National Commission for Awarding the Signature Right (CNADS), according to art. 29-art. 34 of the Methodological Norms for Awarding the Signature Right. For the full description of the procedure, please visit the link below: ……………………………… Means of appeal: With reference to the interview for awarding the signature right, the applicant shall make an appeal against CNADS, in accordance with art. 40 of the 2018 Methodological Norms on Awarding the Signature Right. The applicant can also bring the action before administrative court, in keeping with Law no. 554/2004. With reference to the pursuit of the profession, given the provisions of art. 95 paragraph (1) of ROF, the person injured by the services provided by an OAR member architect shall file a disciplinary complaint which shall be settled by the OAR competent disciplinary commission. The injured person can also use the internal law procedures in order to settle any conflict (OAR-architect, OAR-beneficiary, architect-client, architect-architect). Appeal routes
With reference to the procedure for conducting the interview for granting the right of signature, the applicant has the possibility to file an appeal according to art. 40 of the Methodological Norms for granting the right of signature. Also, the applicant may challenge the CNADS decision in administrative court, according to Law no. 554/2004.
With reference to the practice of the profession, considering the provisions of art. 95 para. (1) of the ROF, the person harmed by the services provided by an architect member of the OAR may file a disciplinary complaint, which will be resolved by the competent OAR Disciplinary Commission.
Also, for the settlement of a possible dispute (OAR-Architect, OAR-Beneficiary, Architect-Beneficiary, Architect-Architect), the injured person may resort to domestic legal procedures.
