Acquiring signature right in Romania_EU, SEE, Swiss Confeder. nationals_establishment in Romania_with signature right_equivalent right The Romanian Order of Architects is the competent authority for the recognition of the official qualification titles for the architect profession for the nationals of the Member States of the European Union, nationals of the Member States of the European Economic Area and nationals of the Swiss Confederation. The signature right is granted by the automatic recognition of the qualification title and the signature right. The recognition of the qualification title and of the signature right are achieved by the National Commission for the Recognition of Qualifications (CNRC). For the full description of the procedure, please visit the link below: …………………… Means of appeal: With reference to the recognition of the qualification and of the signature right, the applicant can bring the action against the CNRC decision before administrative court, in keeping with Law no. 554/2004. With reference to the pursuit of the profession, given the provisions of art. 95 paragraph (1) of ROF, the person injured by the services provided by an OAR member architect shall file a disciplinary complaint, which shall be settled by the OAR competent disciplinary commission. The injured person can also use the internal law procedures in order to settle any conflict (OAR-architect, OAR-beneficiary, architect-client, architect-architect). Any interested person can look for an architect with the signature right by visiting SIOAR - https://www.sioar.ro/membersearch or by consulting The National Architects’ Register (TNA), published yearly in the Official Journal, part I. Law no. 200 of May 25, 2004 regarding the recognition of diplomas and professional qualifications for regulated professions in Romania. In Romania, the profession of architect is regulated by Law no. 184/2001 and GD 932/2010.*

Regarding the recognition of the qualification title, the applicant may challenge the CNRC decision in administrative court, according to Law no. 554/2004.

With respect to the procedure for conducting the interview for granting the right of signature, the applicant has the possibility to file a contestation according to art. 40 of the Methodological Norms for granting the right of signature. Also, the applicant may challenge the CNADS decision in administrative court, according to Law no. 554/2004.

Regarding the exercise of the profession, considering the provisions of art. 95 para. (1) of the ROF, the person harmed by the services provided by an architect who is a member of OAR may file a disciplinary complaint, which will be resolved either by the OAR Territorial Disciplinary Commission or by the OAR National Disciplinary Commission.

Also, in order to resolve a possible dispute (OAR-Architect, OAR-Beneficiary, Architect-Beneficiary, Architect-Architect), the injured person may resort to procedures under domestic law.
