The approval required for the transfer of ownership of agricultural land located outside built-up areas may be requested by any person who owns agricultural land outside built-up areas, for the purpose of selling it.
For the application of the provisions of this procedure, the town halls have the following duties (according to Order No. 719/740/M.57/2333 of May 12, 2014, regarding the approval of the methodological norms for the application of Title I of Law No. 17/2014 regarding some regulatory measures for the sale-purchase of agricultural lands located outside built-up areas and for the amendment of Law No. 268/2001 regarding the privatization of commercial companies managing publicly and privately owned state lands intended for agricultural use and the establishment of the State Domains Agency):
a) register the seller's request, accompanied by the offer to sell the agricultural land and the supporting documents provided for in art. 5 para. (1);
b) display the offer for sale at the town hall headquarters and on its website, as the case may be, in compliance with the provisions of art. 6 para. (2) of the law and with the legal provisions regarding the protection of personal data;
c) notify preemptors, within the term provided by art. 6 para. (6) of the law, by sending the notification regarding the registration of the offer for sale to their domicile, residence, or headquarters, as the case may be; the notification is sent by mail and/or by electronic mail, with acknowledgment of receipt;
d) display the notification to preemptors at the town hall or on the town hall's website, in compliance with the legal provisions regarding the protection of personal data, in case the holders of the right of preemption from the list of preemptors cannot be contacted;
e) notify the local public authority adjoining the area of land subject to the intention of sale, if this area is located at the boundary of two administrative territories, in order to notify the holders of the right of preemption, under the conditions stipulated in lett. c) and d);
f) send to the central structure for lands with an area of more than 30 ha, respectively to the territorial structures for lands with an area of up to 30 ha inclusive, as the case may be, as well as to A.D.S., within the term provided for in art. 6 para. (5) of the law, the file regarding the request and offer for the sale of agricultural land, together with the supporting documents, as the case may be, accompanied by the list of preemptors, the acts issued in exercising the duties provided for in lett. c)-e), as well as the minutes of the display of the offer, in the model provided in Annex no. 1I;
