The notice required for the transfer of agricultural land located outside the city limits can be requested by any person who owns agricultural land outside the city limits, for the purpose of selling it.
For the application of the provisions of this procedure, the town halls have the following responsibilities (according to Order No. 719/740/M.57/2333 of May 12, 2014 on the approval of methodological rules for the application of Title I of Law No. 17/2014 regarding certain regulation measures for the sale-purchase of agricultural land located outside the city limits and for the amendment of Law No. 268/2001 regarding the privatization of commercial companies that administer state-owned public and private land with agricultural purpose and the establishment of the State Domains Agency).


Within 45 working days from the posting of the sale offer at the town hall, under penalty of forfeiture, any holder of the pre-emption right wishing to exercise this right shall file with the town hall the communication of acceptance of the sale offer, in accordance with the template provided in Annex no. 1E.


(2) For the exercise of the pre-emption right for purchasing agricultural land located outside the city limits, first-rank preemptors—the co-owners, spouses, relatives up to the third degree, and in-laws up to the third degree—shall submit the communication of acceptance of the sale offer.
