Acquiring temporary or occasional signature right The Romanian Order of Architects is the competent authority for the recognition of the official qualification titles for the architect profession for nationals of the Member States of the European Union, nationals of the Member States of the European Economic Area and nationals of the Swiss Confederation. The temporary or occasional signature right is granted by the automatic recognition of the qualification title and the signature right, achieved by the National Commission for the Recognition of Qualifications (CNRC). For the full description of the procedure, please visit the link below: …………………………… Means of appeal: With reference to the recognition of the qualification and the signature right, the applicant can bring the action against CNRC decision before administrative court, in keeping with Law no. 554/2004. With reference to the pursuit of the profession, given the provisions of art. 95 paragraph (1) of ROF, the person injured by the services provided by an OAR member architect shall file a disciplinary complaint which shall be settled by the OAR competent disciplinary commission. The injured person can also use the internal law procedures in order to settle any conflict (OAR-architect, OAR-beneficiary, architect-client, architect-architect). Any interested person can look for an architect with the temporary signature right by visiting SIOAR - https://www.sioar.ro/membersearch. With a view to having his qualification and his signature right recognized, the applicant can submit a file, compiled according to point 1 in the full description of the procedure, through PSC. Subsequent to acquiring the temporary signature right, the architect shall be enrolled in an electronic Register and in SIOAR and shall be able to use it: https://www.sioar.ro/. Regarding the recognition of the qualification title and the right of signature, the applicant may challenge the CNRC decision in administrative litigation, according to Law no. 554/2004.
Concerning the practice of the profession, given the provisions of art. 95 para. (1) of the ROF, the person prejudiced by the services provided by an architect member of OAR may file a disciplinary complaint, which will be resolved by the competent OAR Disciplinary Committee.
At the same time, in order to resolve a potential dispute (OAR-Architect, OAR-Beneficiary, Architect-Beneficiary, Architect-Architect), the prejudiced person may resort to procedures under domestic law.
