The operating permit issued under the conditions of this procedure allows traders, natural or legal persons authorized under the law, to carry out wholesale trade activities. These activities refer to the food and non-food products provided in the annex to Government Ordinance no. 99/2000 on the marketing of products and market services, republished, as well as other applicable regulatory acts.

In order to obtain the operating permit, the trader shall address the Cluj-Napoca City Hall by submitting an application – Form B - STANDARD REQUEST for the issuance of the operating permit in which both the identification elements of the trader shall be entered: trader’s name, registered office, fiscal identification code, registration number at the Trade Register, representative – as well as the address of the work point for which the operating permit is requested, the activities to be carried out at this work point, and the proposed operating schedule. This standard application shall be accompanied by documentation consisting of documents established in accordance with the activity to be carried out at the work point, in compliance with the relevant legislative provisions. The structure handling the application is the Directorate of Municipal Heritage and Property Records, Trade Authorization Service.

If this certificate of findings includes activities that are not actually carried out at the work point and for which no operating permit is requested, the trader's administrator will submit a statement made on their own responsibility regarding the activities carried out at the work point.*

The function registered in the land register must be in strict correlation with the provisions of the approved urban planning regulations, complying with the classification of permitted uses by categories of functions, according to the current Local Urban Planning Regulation. In the case where the space in question is registered in the land register as a dwelling or has another destination, which is different in function from the one for which the operating permit is requested, the urban planning certificate and the approvals/agreements mentioned therein / the building permit, if applicable, issued by the Urban Planning Directorate for the change of destination/function based on the provisions of the approved urban planning regulations must be presented, complying with the classification of permitted uses by categories of functions. In the situation where the commercial/service activity is to be carried out in a temporary and demountable structure, for which there is a building permit, such as a kiosk, booth, or stand or other similar structures (for commercial activity), located on private property (except for those placed on public or private property of the municipality), the updated land register of the land on which this structure is located must be presented, no older than 90 days, if it is not possible to present a land register with the registration of this construction. An excerpt from the land register will NOT be presented in the case of spaces with other destinations that are the subject of lease contracts with the local public administration authority.*
