STANDARD REQUEST for the issuance of the operating permit, which will include both the identification elements of the merchant: merchant name, registered office, Tax Identification Code (CUI), registration number at the Trade Registry Office, representative, address of the work point for which the operating permit is requested, activities to be carried out at this work point, proposed operating hours. This standard request is accompanied by documentation that includes documents established in correlation with the activity to be carried out at the work point, in compliance with the applicable legislative provisions.*

The certificate of findings regarding the activities carried out at the work point which is the subject of the request, issued by the Trade Register Office, contains strict information regarding the work point and lists the activities that are actually carried out at the work point. If this certificate of findings includes activities that are not actually carried out at the work point and for which no operating permit is requested, the trader's administrator will submit a statement made on their own responsibility regarding the activities carried out at the work point.*

The updated land register, no older than 90 days, of the property where the commercial or service activity is carried out, with the registration of the corresponding function. The function registered in the land register must be in strict correlation with the provisions of the approved urban planning regulations, complying with the classification of permitted uses by categories of functions, according to the current Local Urban Planning Regulation. In the case where the space in question is registered in the land register as a dwelling or has another destination, which is different in function from the one for which the operating permit is requested, the urban planning certificate and the approvals/agreements mentioned therein / the building permit, if applicable, issued by the Urban Planning Directorate for the change of destination/function based on the provisions of the approved urban planning regulations must be presented, complying with the classification of permitted uses by categories of functions. In the situation where the commercial/service activity is to be carried out in a temporary and demountable structure, for which there is a building permit, such as a kiosk, booth, or stand or other similar structures (for commercial activity), located on private property (except for those placed on public or private property of the municipality), the updated land register of the land on which this structure is located must be presented, no older than 90 days, if it is not possible to present a land register with the registration of this construction. An excerpt from the land register will NOT be presented in the case of spaces with other destinations that are the subject of lease contracts with the local public administration authority.*

Traders who do not own the space associated with the work point to be authorized will submit, in addition to the documents mentioned in the previous point, any document/contract that regulates the lease in their favor. If this lease regulation document is not for an indefinite period, it is considered that the authorization request is made for a limited period, within the validity of the lease.*

The written agreement of the co-owners - co-divisors (where applicable) shall be given with the specification of the identification data of the signatories, namely the identity document and personal numeric code*

The site plan showing the location of the building where the commercial or service activity is carried out: site plans taken from the internet are also valid.*

A photograph of the sales structure facade will be presented, showing the access to it.*

The plan intended to remain unchanged, attached to the building permit related to the sales structure space or the survey of the respective space, will be presented.*

It is a standard form that includes information regarding the sales structure.*

The fire safety authorization or rejection issued by the competent authority, the Inspectorate for Emergency Situations "Avram Iancu" of Cluj County.*

The document issued by the Sanitary-Veterinary Directorate of Cluj County for the activities included in annex 6 to HCL 851/2017 (see normative acts)*

The certificate of completion of hygiene courses or the diploma of graduation from a high school with an economic profile will be presented, for employed personnel.*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure being authorized.*

A copy of the building permit/subscription for the occupation of public domain with access ways, valid, shall be presented in case the access to the sales structure subject to authorization is made on distinct arrangements made on the public domain, other than those corresponding to public alleys. If the sales structure does not have an access way, a declaration on own responsibility shall be submitted by the merchant.*
