According to the provisions of art. 1, para. 1 of Law no. 554/2004 on administrative litigation, any person who considers themselves harmed in a right of theirs or in a legitimate interest, by a public authority, through an administrative act or by the failure to resolve a request within the legal timeframe, may address the competent administrative litigation court, for the annulment of the act, recognition of the claimed right or legitimate interest, and compensation for the damage caused to them. According to the provisions of art. 7, para. 1 of the same law, before addressing the competent administrative litigation court, the person who considers themselves harmed in a right of theirs or in a legitimate interest through an individual administrative act addressed to them must request the issuing public authority or the hierarchically superior authority, if it exists, within 30 days from the communication of the act, the revocation, in whole or in part, of this act.
