Request for license for the public sanitation service of localities or for one or more specific activities of this service, provided in the manner of direct management by local or county public interest services, with legal personality, established and organized by decisions of the deliberative authorities of the administrative-territorial units - https://www.anrsc.ro/gestiune-directa-salubrizare/
Resolution cord: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additional documents requested by A.N.R.S.C.
Procedure description: The documents submitted by the applicant for granting the license for a public utility service/activity are analyzed by A.N.R.S.C., and in if necessary, the regulatory authority sends the applicant a letter informing them of the obligation to make additions, corrections or clarifications regarding the application and the submitted documents, within 30 days from the registration of the documentation.
If , within 30 days from the date of the request for additions, the applicant does not provide all the appropriate documentation provided by the regulation, including the requested additions, A.N.R.S.C. will return to them the related documentation, deleting the respective request from the license granting procedure, communicating this decision to the applicant.
Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:
a) summoning, at the headquarters of A.N.R.S.C., the authorized representatives of the applicant, in order to clarify certain aspects that arise/do not arise from the documentation provided;
b) on-site verification of the accuracy of the data in the documentation sent by the applicant.
A.N.R.S.C., through the specialized department, prepares a specialized report that includes the justified proposal for granting/rejecting the license and which will be submitted for analysis to the Licensing Commission, by the commission secretary.
The proposal for granting/rejecting the license is put to a vote within the Licensing Commission.
Grantingstatus/rejection of the license is made by order of the president of A.N.R.S.C..
In the event of granting the license, A.N.R.S.C. communicates to the applicant the fiscal invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date of communication of the invoice.
After payment confirmation, A.N.R.S.C. sends the applicant within a maximum of 5 days the order of the president of A.N.R.S.C. granting the license accompanied by the license and its associated conditions.
If the 30-day deadline for payment of the license granting fee is not met, A.N.R.S.C. will proceed to withdraw the license.
In the case of refusal to grant the license, A.N.R.S.C. sends to the applicant within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. of rejection of the license accompanied by the reasons for the refusal.
In case the license granting is rejected, the applicant can no longer submit new license documentation earlier than 6 months from the date of the order of rejection.
Final document:
a) Order for granting the license, accompanied by the license and the associated license conditions;
b) Order for rejection of the license, accompanied by the reasons for the refusal to grant it;
c) Notification regarding the removal of the application from the procedure.
Notification deadline upon expiration of the resolution term: 5 days from the date of confirmation of payment of the license granting fee, in the case of granting the license, respectively 5 days from the date of issuance of the order of rejection of the license.
