Request for a license for the public sanitation service of localities or for one or more specific activities of this service, provided in the modality of direct management by companies with fully public capital - https://www.anrsc.ro/gestiune-directa-salubrizare/
Processing time: 60 days from the registration of the documentation or 30 days from cloud transmission by the public utility service operator regarding the completions requested by A.N.R.S.C.
Procedure description: The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a notice informing them of the obligation to make additions, corrections or clarifications, regarding the application and the documents submitted, within 30 days from the registration of the documentation.
In case , within 30 days from the date of the request for additions, the applicant does not provide all the corresponding documentation provided by the regulation, including the requested additions, A.N.R.S.C. will return the related documentation, striking out the respective application from the license granting procedure, communicating this decision to the applicant.
Depending on the way of presentation and the complexity of the information contained in inline documentation submitted by the applicant, A.N.R.S.C. may decide:
a) summoning, at the headquarters of A.N.R.S.C., the authorized representatives of the applicant, to clarify certain aspects that result/do not result from the documentation provided;
b) on-site verification of the reality of the data from the documentation submitted by the applicant.
A.N.R.S.C., through the specialized department, draws up a specialist report that includes the reasoned proposal for granting/rejection of the license which will be presented for analysis to the Licensing Commission, by the secretary of the commission.
The proposal for cost granting/rejection of the license is submitted to a vote within the Licensing Commission.
The granting/rejection of the license is made by order of the president of A.N.R.S.C..
In case of granting the license, A.N.R.S.C. communicates to the applicant the fiscal invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date of communication of the invoice.
After payment confirmation, A.N.R.S.C. sends to the applicant in maximum 5 days, the order of the president of A.N.R.S.C. for granting the license accompanied by the license and the conditions associated with it.
In case of non-compliance with the 30-day term for paying the license granting fee, A.N.R.S.C. will proceed to withdraw the license.
In case of refusal to grant the license, A.N.R.S.C. sends the applicant, within a maximum of 5 days from the issuance, the order of the president of A.N.R.S.C. for rejection of the license accompanied by the reasons for the refusal to grant.
For the situation in which the granting of the license was rejected, the applicant may not submit a new licensing documentation earlier than 6 months from the date of issuance of the rejection order.
Final document:
a) License granting order, accompanied by the license and the conditions associated with the license;
b) License rejection order, accompanied by the reasons for the refusal to grant;
c) Notification regarding the deletion of the application from the procedure.
Notification period at the “expiry of the processing term”: 5 days from the date of confirmation of payment of the license granting fee, in the case of license granting, or 5 days from the date of issuance of the license rejection order.
