Request for a license for the public water supply service, provided through direct management by public services of local or county interest, with legal personality, established and organized by decisions of the deliberative authorities of administrative-territorial units - https://www.anrsc.ro/gestiune-directa-apa-canal/
Resolution time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additions requested by A.N.R.S.C.
Procedure description: The documents submitted by the applicant for the purpose of granting a license for a public service/activity are analyzed by A.N.R.S.C., and in the event that it is necessary, the regulatory authority sends the applicant a letter informing them of the obligation to make additions, corrections, or clarifications regarding the application and submitted documents, within 30 days from the registration of the documentation.
If, within 30 days from the date of the request for additions, the applicant does not provide all the corresponding documentation required by the regulation, including the requested additions, A.N.R.S.C. will return the respective documentation, deleting the application from the license granting procedure, communicating this decision to the applicant.
Depending on the manner of presentation and the complexity of information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:
a) the summoning, at the A.N.R.S.C. headquarters, of authorized representatives of the applicant, to clarify certain aspects arising/not arising from the documentation provided;
b) verification, on-site, of the reality of the data from the documentation transmitted by the applicant.
A.N.R.S.C., through its specialized department, prepares a specialist report which includes the justified proposal for granting/rejecting the license and will be presented for analysis to the Licensing Commission by the Commission secretary.
The proposal for granting/rejecting the license is subject to a vote within the Licensing Commission.
Granting/rejecting the license is carried out by order of the president of A.N.R.S.C.
In the case of granting the license, A.N.R.S.C. communicates to the applicant the fiscal invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date the invoice is communicated.
After payment confirmation, A.N.R.S.C. sends the applicant within a maximum of 5 days, the order of the president of A.N.R.S.C. for granting the license, accompanied by the license and its associated conditions.
If the 30-day deadline for payment of the license granting fee is not respected, A.N.R.S.C. will proceed with the withdrawal of the license.
In case of refusal to grant the license, A.N.R.S.C. sends the applicant, within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. for rejection of the license, accompanied by the reasons for refusal.
In case the license granting is rejected, the applicant may not submit a new licensing documentation less than 6 months from the date of issuance of the rejection order.
Final document:
a) Order for granting the license, accompanied by the license and the conditions associated with the license;
b) Order for rejection of the license, accompanied by the reasons for refusal;
c) Notification regarding the removal of the application from the procedure.
Notification deadline upon expiration of the resolution period: 5 days from the date of payment confirmation of the license granting fee, in the case of granting the license, respectively 5 days from the date of issuance of the rejection order of the license.
