Procedure regarding the automatic recognition of teaching positions in university education obtained in accredited foreign university institutions, within the “ARTIFEX” University of Bucharest*

Purpose
Through this procedure, the automatic recognition is achieved, within the “ARTIFEX” University of Bucharest, of teaching positions in higher education obtained in accredited higher education institutions from abroad, only if they were obtained in: accredited higher education institutions from member states of the European Union, the European Economic Area and from the Swiss Confederation; prestigious higher education institutions from other states provided in the List of prestigious universities from other states, approved by order of the Minister of the field, periodically updated. Teaching positions obtained in accredited higher education institutions from abroad, other than those mentioned above, may be recognized by the “ARTIFEX” University of Bucharest, subject to compliance with the minimum requirements regarding the occupation of a teaching position according to the criteria provided by art. 25, 27, 29, and 30 (with the exception of the requirement to hold the habilitation certificate, in case in the national education system of the candidate’s country of origin, gaining the title of professor automatically confers also the title of PhD supervisor) from the Competition Methodology for occupying the vacant teaching positions within “ARTIFEX” University of Bucharest.
Target persons
The procedure applies to Romanian citizens, citizens of the European Union member states, the European Economic Area, the Swiss Confederation, and citizens from third states.
The exercise of the rights conferred by the recognized teaching position and the occupation of teaching positions in the Romanian higher education system are carried out in accordance with the legal regulations in force.
Limits
The recognition of the teaching position by the “ARTIFEX” University of Bucharest is valid and produces legal effects at the university level.
Procedure description
1. Submission of the file
In order to recognize the teaching position, the applicant submits the recognition file which includes the following documents:
a) recognition request submitted in person by the applicant;
b) identity document – copy (certified by the competent authorities from the country of origin) and certified translation (if applicable);
c) proof of name change (if applicable) – copy (certified by the competent authorities from the country of origin) and certified translation (if applicable);
d) PhD diploma – copy (certified by the issuing institution), if the study document was obtained in Romania, or PhD diploma – copy (certified by the issuing institution) and certified translation (if applicable), if the study document was obtained abroad;
e) certificate of recognition of the PhD diploma, according to the legal provisions, if the PhD diploma was obtained abroad;
f) proof of the teaching position, issued by the institutions provided in art. 11;
g) documents proving the classification of the issuing institution, according to art. 11;
h) proof of payment of the evaluation fee approved by the Board of Directors of the “ARTIFEX” University of Bucharest;
i) habilitation certificate (if applicable), recognized according to legal provisions;
j) CV, publication list and scientific contributions in the field.
The file can be submitted to the general secretariat of the university or sent by mail or through the "Single Electronic Contact Point" platform.
The evaluation fee, in the amount of 1,000 lei can be paid into the account of the “ARTIFEX” University of Bucharest, CUI 17656965, IBAN RO42BTRLRONCRT0658609501, opened at Banca Transilvania, or at the university’s cashier’s office, in cash or by bank card.
If it is found that the file does not contain the required documents, the applicant is notified in writing to complete it. The deadline for completing the file is a maximum of 15 calendar days from the date of notification.
The complete file is forwarded to the recognition committee which will evaluate and make a decision regarding the request.
2. Evaluation procedure
For the recognition of teaching positions in higher education obtained in accredited higher education institutions from abroad, the rector of the “ARTIFEX” University of Bucharest proposes to the Senate the recognition committee, which is approved by the Senate and appointed by rector’s decision.
The recognition committee may include alternate members, specialized teaching staff.
The recognition committee is composed of 5 members, including: the president of the recognition committee, the university’s legal adviser or a tenured teaching staff from the field of Law, and three teaching staff with the title of full professor and/or associate professor tenured in the university and/or from outside the university.
The decisions of the recognition committee are taken by simple majority of the votes cast by the committee members.If any suspicions arise regarding the authenticity of the study documents, the committee notifies the competent authorities.
The committee will draft an Evaluation Report which contains the solution (approval or rejection) regarding the recognition request.
The report drafted by the Recognition Committee, signed by all committee members and registered in the University’s Incoming/Outgoing Registry, is submitted for approval to the University Senate.
The recognition or non-recognition decision is issued by the rector of the “ARTIFEX” University, in accordance with the Senate’s decision and will be sent to the applicant.
The resolution time for files is a maximum of 30 working days from the date of registration of the complete file. The resolution period mentioned above may be extended in clarly justified cases, the applicant being informed in writing, by postal courier or electronic mail.
The recognition certificate will be prepared in two copies, one of which is sent to the applicant and one will be archived at the general secretariat of the university.
4. Issuing a duplicate
In case of loss, destruction or deterioration of the recognition decision, the “ARTIFEX” University shall issue, upon request, a duplicate of it, based on a notarial declaration regarding the situation.
The request is made in writing and is accompanied by the identity document - copy certified by the competent authorities from the country of origin and certified translation (if applicable), proof of name change (if applicable) - copy certified by the competent authorities from the country of origin and certified translation (if applicable), as well as proof of payment of the duplicate fee.

The decision of the Rector may be appealed only once, within 10 working days from the notification, by a motivated request submitted to the general secretariat of the University or sent by mail.
The appeal resolution period is 10 working days from the date of registration.
In the situation where the applicant for recognition files an appeal, the Rector appoints an appeal committee, with the same structure as the Recognition Committee, in which other persons than the members of the Recognition Committee will be appointed.
The members of the committees will decline participation in case of a possible incompatibility specified by the regulations in force.
