The sale of agricultural land located outside the city limits, without respecting the right of preemption or without obtaining the permits, is prohibited and sanctioned with absolute nullity.

The publicity of the sale offer of agricultural land located outside the city limits - the person who wishes to sell must register, at the City Hall in whose administrative area the land is located, an application requesting the posting of the sale offer of the respective area, in order to notify the preemptors. Within 5 working days from the registration of the application, the City Hall will post the sale offer, for 45 working days, at its headquarters. Also, within 10 days, the City Hall is obliged to notify the holders of the right of preemption regarding the registration of the sale offer. In case the right of preemption is not exercised, potential buyers can submit to the City Hall a file containing the supporting documents regarding the fulfillment of the conditions, within 30 days from the expiration of the aforementioned 45 working days period. In case the right of preemption is not exercised and if none of the aforementioned potential buyers, within the legal term, meet the conditions to purchase the agricultural land located outside the city limits, the transfer of this land by sale can be made to any natural or legal person, under the conditions of the law.
