Issuance of certificates attesting property rights over land for economic operators*

The responsibility for organizing the action of establishing and evaluating the lands found in the patrimony of state-owned commercial companies lies with the line ministries, county councils and the council of the Municipality of Bucharest, as well as the boards of directors of state-owned commercial companies.

The bodies which, according to the law, fulfill the duties of the line ministry, as well as the county public administrative authorities, will issue to commercial companies certificates of attestation of the right of ownership over the lands. These certificates are subject to the real estate publicity regime.

The certificates of attestation of the right of ownership over the lands are issued by the line ministries and will be signed by the ministers, for the state-owned commercial companies established by Government decision, and by the county councils or by the General Council of the Municipality of Bucharest, signed by the presidents, respectively by the mayor general of the Municipality of Bucharest and their secretaries, for those established by decisions of the local and county councils or by decision of the General Council of the Municipality of Bucharest.

The documentation based on which the certificates are to be issued:

a) the zoning plan of the state-owned commercial company, scale 1 : 10,000 up to 1: 100,000, drawn up by the applying commercial company, on which the following will be highlighted:

- the main communication routes;

- the main utility networks;

- important commercial companies or autonomous administrations in the area, neighbors, etc.;

b) plan sheets drawn up by the applying commercial company (Annex no. 5), comprising the area of the existing premises resulted from the summation of the areas based on topographic measurements;

c) the situation regarding the establishment of the lands found in the patrimony of state-owned commercial companies (Annex no. 2);

d) the situation regarding the qualitative evaluation of the released lands.

The documentation regarding the establishment of the land found in the patrimony of state-owned commercial companies, together with the certificate of attestation of the right of ownership over the land, in copy, will be sent for registration, as follows:

a) for state-owned commercial companies established by Government decision:

- one copy to the county or Bucharest municipal cadastre and real estate publicity office - one copy to the Urbanism and Territorial Planning Department within the county or Bucharest municipal council;

- one copy to the ministry under which the commercial company is subordinated;

- one copy to the commercial company holding the land;

- one copy to the Ministry of Transport, Construction and Tourism*) - General Directorate for Localities Management. State-owned commercial companies, within 15 days from obtaining the certificate of attestation of the right of ownership over the land, are obliged to register it in the real estate publicity documents provided by law.

Following the analysis of the documentation regarding the areas of land in the patrimony of state-owned commercial companies, which are determined as necessary for the object of activity provided in the establishment act, the respective documentation will be forwarded for the issuance of the certificate of attestation of the right of ownership over the land, as follows:

a) for state-owned commercial companies established by Government decision, to the line ministry;

b) for state-owned commercial companies, established by decisions of the local public administration authorities, to the county councils or to the General Council of the Municipality of Bucharest, as the case may be.
