Withdrawal of Romanian Citizenship*
Any authority or person who is aware of the existence of grounds for the withdrawal of Romanian citizenship may notify, in writing, the Citizenship Commission, being obliged to present the evidence at their disposal. The President of the Commission shall, by resolution, establish the date on which the withdrawal notification will be debated, also ordering - the request of the competent authorities’ point of view regarding the fulfillment of the legal conditions for the withdrawal of citizenship - the invitation of the person who made the notification, as well as any person who could provide useful information for the resolution of the request - the summoning of the person concerned at their known residence or, if this is not known, by publishing the summons in the Official Gazette of Romania, Part III.
The summoning of the person takes place at least 6 months before the set date for the debate of the notification. On the date set for the debate of the notification, the Commission verifies the fulfillment of the necessary conditions for the withdrawal of Romanian citizenship. It hears the summoned persons as well as the person concerned. The absence of the legally summoned person does not prevent the proceedings for the withdrawal of Romanian citizenship from taking place.
If it finds the fulfillment or, as the case may be, failure to fulfill the legal conditions for the withdrawal of Romanian citizenship, the Commission shall propose to the President of the National Citizenship Authority, through a motivated report, the approval of the withdrawal of Romanian citizenship or, as the case may be, the rejection of the notification.
The President of the National Citizenship Authority, finding the fulfillment of the legal conditions, issues the order for the withdrawal of Romanian citizenship, or, in the case of finding failure to meet the legal conditions, the rejection of the notification for the withdrawal of citizenship. The order of the President of the National Citizenship Authority for the acceptance or rejection of the notification for the withdrawal of citizenship is communicated to the person concerned, as well as to the person who made the notification, by registered letter with acknowledgment of receipt.
