Filing an application for the registration of a design or model at OSIM*
The filing of an application for registration of a design/model with OSIM is not mandatory and is subject to a fee, the fee regime being established by Government Ordinance no.41/1998, regarding fees in the field of industrial property protection and the regime of their use, with subsequent amendments and completions. The form entitled “Application for Design/Model Registration” must be completed in 3 copies, accompanied by graphic reproductions and proof of payment of the related fees. It can be submitted online, by post or at the OSIM headquarters. The examination of a design/model registration application is carried out in accordance with the provisions of Law 129/1992 regarding the protection of designs and models, republished in 2007, as well as its Implementing Regulations. Public registers can be consulted here, and OSIM’s decisions are subject to appeal.

Filing a utility model application*
Filing a utility model application with OSIM is not mandatory and is subject to a fee, the fee regime being established by Government Ordinance no. 41/1998, regarding fees in the field of industrial property protection and their usage regime, with subsequent amendments and additions.
The standard form “Utility Model Application” must be filled out in 3 copies accompanied by the related documents consisting of: abstract, description, drawings (if applicable), claims.
These can be submitted by mail or at the OSIM headquarters. Examination of a utility model application is conducted in accordance with the provisions of Law 350/2007 regarding utility models, as well as its Implementation Regulation. OSIM decisions are subject to appeal:
