Accreditation of providers of information and professional counseling services*
AJOFM/AMOFM Bucharest notification by accredited/notified providers of employment services regarding the establishment in Romania of branches/subsidiaries/secondary offices that provide labor mediation/professional information and counseling services*
The procedure targets the obligation of notifying AJOFM/AMOFM Bucharest by providers of job placement services on the Romanian internal market/information and professional counseling services subject to accreditation/notification, except for individuals authorized to carry out independent activities and providers established in another EU/EEA member state who provide such services on a cross-border basis on the territory of Romania, temporarily/occasionally, regarding the establishment on the territory of Romania of branches/subsidiaries/secondary offices whose activities concern these services, regulated by the Accreditation Criteria for Providers of Specialized Services for Stimulating Employment, approved by Government Decision no. 277/2002, with subsequent amendments and completions. The obligation is considered fulfilled when the notification is submitted to AJOFM/AMOFM Bucharest in the area where the respective branches/subsidiaries/other secondary offices operate, together with all documents required by law that accompany this notification.
*Notification of AJOFM/AMOFM Bucharest by the EU and EEA accredited/authorized employment service providers regarding the permanent provision in Romania of labor mediation services on the internal market/information and professional counseling*
The procedure concerns the obligation to notify the AJOFM/AMOFM Bucharest, by providers of employment mediation services and/or professional information and counseling services from other EU and EEA member states accredited/authorized under the legislation of their home state, regarding the provision, on a permanent basis, in Romania, according to the law, of employment mediation services on the internal Romanian market and/or professional information and counseling services, regulated by the Criteria for accrediting providers of specialized services to stimulate workforce employment, approved by Government Decision no. 277/2002, with subsequent amendments and completions. The obligation is considered fulfilled in the case of submitting the notification to the territorial agency of the administrative-territorial unit where they establish themselves permanently in Romania, according to the law, and have a permanent headquarters or, as the case may be, domicile/residence, together with all the documents required by law which accompany this notification.
*Accreditation of providers of labor mediation services on the internal market -Romania*
The accreditation of providers of labor mediation services on the internal market—Romania—is carried out under the conditions provided by Government Decision no. 277/2002, as subsequently amended and supplemented, by ANOFM through the territorial agencies AJOFM / AMOFM Bucharest in whose territorial area the providers have their headquarters or, as the case may be, domicile/residence. Providers of employment services—labor mediation—from EU member states and from the EEA, for whom, in order to provide these services, the legislation of their country of origin did not require obtaining accreditation/authorization and thus are not subject to accreditation/authorization requirements, when providing these activities in Romania, are subject to the same accreditation conditions as providers from Romania, except for providers who intend to provide such services cross-border on the territory of Romania, temporarily/occasionally and who, when performing their activity in Romania, are subject to the notification procedure.
*Notification of AJOFM/AMOFM Bucharest by providers of employment services established in another EU and EEA member state, in the situation where they intend to provide cross-border services on the territory of Romania, on a temporary or occasional basis*
The procedure concerns the obligation to notify AJOFM/AMOFM Bucharest, by providers of job mediation services and/or professional information and counseling services established in another EU or EEA Member State who have the legal right to provide such services under the legislation of the state of origin, whether or not they are subject, as appropriate, to an accreditation/authorization procedure for providing these services, in situations where they intend to provide such cross-border services on the territory of Romania, on a temporary/occasional basis, as regulated by the Accreditation Criteria for providers of specialized services to stimulate employment, approved by Government Decision no. 277/2002, with subsequent amendments and completions. The obligation is considered fulfilled in the situation where the notification is submitted to the territorial agency in whose jurisdiction the activity is intended to be carried out, together with all the documents required by law accompanying this notification.
