Request for issuance/extension of operating permit for commercial activity (Markets/Bazaars)*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of OG no.99/2000 regarding the commercialization of products and market services, any commercial activity is carried out only by authorized merchants under the conditions of the law, and according to art.6 para.(1) and (2) of the same normative act: commerce in public areas is conducted in sales structures with a fixed or mobile headquarters. The exercise of commercialization activity in public areas is subject to the approval of local public administration authorities or the sectors of the Municipality of Bucharest, as applicable, respecting their own regulations and urban planning schemes.

Considering the above-mentioned legal provisions, reported to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the conduct of activities for the commercialization of products and market services on the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the operation agreement/authorization/permit by individuals and legal entities carrying out activities for the commercialization of products and market services in public areas or any other area intended for public use, in sales structures with a fixed or mobile headquarters, permanent, temporary or, as the case may be, seasonal on the territory of Sector 3 of the Municipality of Bucharest.

According to art.2 letter a), the operation agreement is the individual administrative act which establishes the conditions for carrying out activities for the commercialization of products and market services, excluding public food units; letter b) the operation authorization is the individual administrative act which establishes the conditions for carrying out public food activities (restaurant CAEN code 5610, bar CAEN code 5630), and according to letter c), the operation permit is the individual administrative act which establishes the conditions for carrying out temporary and/or seasonal activities for the commercialization of products and market services.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or intend to carry out commercial activities, service activities and public food activities are obliged to submit documentation for obtaining or extending the validity period of the operation agreement/authorization, at least 30 calendar days before the start date of the activity to be carried out or before the expiration date of the initially authorized validity.

The fee for issuing and granting the operation permit/agreement/authorization, as well as the fee for the annual endorsement thereof, are provided in the General Council Decision of the Municipality of Bucharest concerning the establishment of the levels of local taxes and duties in the Municipality of Bucharest. These fees will be paid at the cash desks of Sector 3 City Hall, and proof of payment shall be submitted at the same time as submission of the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4) and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with subsequent amendments and completions, and the Decisions of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and duties in the Municipality of Bucharest, economic agents carrying out public food activities (CAEN code 5610,5630), must pay the public food tax in full, in advance of issuing the authorization, regardless of the period remaining until the end of the respective fiscal year, as follows:

- the fee of 3,000 lei for the issuance/annual endorsement of the Operation Authorization - public food (bar, restaurant), for an area up to 500 m2;
- the fee of 4,000 lei for the issuance/annual endorsement of the Operation Authorization - public food (bar, restaurant), for an area greater than 500 m2.

Request for issuance/renewal of the operating agreement for commercial activity at stall/space in markets/bazaars for SC*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of Article 5, paragraph (1) of Government Ordinance no. 99/2000 regarding the commercialization of market products and services, any commercial activity may only be carried out by authorized merchants under the conditions stipulated by law, and according to Article 6 paragraphs (1) and (2) of the same normative act: commerce in public areas is carried out in sales structures with a fixed or mobile location. The exercise of commercialization activities in public areas is subject to the approval of local public administration authorities or the sectors of Bucharest Municipality, as applicable, in compliance with their own regulations and urban planning schemes.

Considering the legal provisions mentioned above, in relation to the provisions of Article 63 paragraph (5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the conduct of commercialization activities of market products and services within Sector 3 of Bucharest Municipality.

The regulation establishes the procedure for obtaining the operating agreement/authorization/endorsement by individuals and legal entities who carry out commercialization activities of market products and services in public areas or in any other area intended for public use, in sales structures with a fixed or mobile location, permanent, temporary or, as applicable, seasonal, within Sector 3 of Bucharest Municipality.

According to Article 2 letter a), the operating agreement is the individual administrative act which sets the conditions for conducting commercialization activities of market products and services, exclusively public food units; letter b) the operating authorization is the individual administrative act which sets the conditions for conducting public food activities (restaurant CAEN Code 5610, bar CAEN Code 5630), and according to letter c), the operating endorsement is the individual administrative act that establishes the conditions for conducting commercialization activities of products and market services carried out temporarily and/or seasonally.

According to Article 3 of H.C.L.S.3 no. 313/2017:economic agents who carry out or are about to carry out commercial activities, service provision, and public food activities are obligated to submit the documentation for obtaining or extending the validity period of the operating agreement/authorization at least 30 calendar days before the starting date of the activity to be carried out or before the expiration date of the initially authorized validity.

The fee for issuing and releasing the endorsement/agreement/operating authorization, as well as the fee for its annual endorsement, are provided in the Decision of the General Council of Bucharest Municipality regarding the establishment of the levels of local fees and taxes in Bucharest Municipality. These will be paid at the cashier offices within Sector 3 City Hall, and proof of payment will be submitted together with the authorization documentation.

According to the provisions of Article 475 paragraphs (3), (4), and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with subsequent amendments and completions, and the Decisions of the General Council of Bucharest Municipality regarding the establishment of levels of local fees and taxes in Bucharest Municipality, economic agents carrying out public food activities (CAEN code 5610, 5630) must pay the public food fee in full, in advance of the authorization being released, regardless of the remaining period until the end of the respective fiscal year, as follows:

Request for the issuance of the operating permit for seasonal terraces (CAEN code 5630,5610)*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) from GO no.99/2000 regarding the marketing of products and market services, any commercial activity is carried out only by authorized traders under the conditions of the law, and according to art.6 para.(1) and (2) from the same regulatory act: commerce in public areas is carried out in fixed-location or ambulant sales structures. The exercise of commercial activity in public areas is subject to the agreement of the local public administration authorities or of the sectors of Municipality Bucharest, as the case may be, with respect to their own regulations and urban planning.

Taking into account the aforementioned legal provisions, related to the provisions of art.63 para.(5) letter g) from the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the conduct of marketing activities for products and market services on the territory of Sector 3 of Municipality Bucharest.

The regulation establishes the procedure for obtaining the agreement/authorization/operating notice by natural and legal persons who carry out marketing activities of products and market services in public areas or in any other area intended for public use, in fixed or ambulant sales structures, permanent, temporary or, as the case may be, seasonal on the territory of Sector 3 of Municipality Bucharest.

According to art.2 letter a), the operating agreement is the individual administrative act, establishing the conditions for conducting marketing activities of products and market services, excluding public food units; letter b) the operating authorization is the individual administrative act, establishing the conditions for conducting public food activities (restaurant NACE code 5610, bar NACE code 5630), and according to letter c), the operating notice is the individual administrative act, establishing the conditions for conducting the marketing activities of products and market services carried out temporarily and/or seasonally.

According to art.3 from H.C.L.S.3 no. 313/2017: economic agents who conduct or intend to conduct commercial, service providing, and public food activities have the obligation to submit documentation for obtaining or extending the validity of the operating agreement/authorization, at least 30 calendar days before the start date of the activity to be undertaken or before the expiry date of the initially authorized validity.

The fee for issuing and releasing the operating notice/agreement/authorization, as well as the annual endorsement fee, is provided in the General Council Decision of Municipality Bucharest regarding the establishment of the levels of local taxes and fees in Municipality Bucharest. These will be paid at the cashier offices within the City Hall of Sector 3, and proof of payment will be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4), and (5) of Law no. 227/2015 regarding the Romanian Fiscal Code, with subsequent amendments and completions, and the Decisions of the General Council of Municipality Bucharest regarding the establishment of the levels for local taxes and fees in Municipality Bucharest, economic agents conducting public food activities (NACE code 5610, 5630) must pay the public food tax in full, in advance of the issuance of the authorization, regardless of the remaining period until the end of the respective fiscal year, as follows:

- the fee in the amount of 3,000 lei for the issuance/annual endorsement of the Operating Authorization - public food (bar, restaurant) for an area up to 500 m2;
- the fee in the amount of 4,000 lei for the issuance/annual endorsement of the Operating Authorization - public food (bar, restaurant) for an area greater than 500 m2.

Request for extension of operating permit – public catering CAEN code 5610; 5630 (other than hotels)*

COMMERCIAL AUTHORIZATION PROCEDURE

The exercise of commercial activity in public areas is subject to the approval of the local public administration authorities or the sectors of the Municipality of Bucharest, as the case may be, in compliance with their own regulations and urban planning plans.

Considering the above-mentioned legal provisions, reported to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulations regarding the conduct of activities for the commercialization of products and market services on the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the approval/authorization/operating permit by individuals and legal entities who carry out activities for the commercialization of products and market services in public areas or in any area of another nature intended for public use, in sales structures with a fixed or mobile headquarters, permanently, temporarily or, as the case may be, seasonally on the territory of Sector 3 of the Municipality of Bucharest.

According to art.2 letter a), operating approval is the individual administrative act by which the conditions for carrying out commercialization activities of products and market services are established, excluding catering units; letter b) operating authorization is the individual administrative act by which the conditions for carrying out catering activities (restaurant CAEN Code 5610, bar CAEN Code 5630) are established, and according to letter c), operating permit is the individual administrative act by which the conditions for carrying out temporarily and/or seasonally conducted commercialization activities of products and market services are established.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who conduct or are about to conduct commercial, service-providing, and catering activities, are obliged to submit the documentation in order to obtain or extend the validity of the approval/authorization for operation, at least 30 calendar days before the date of commencement of the activities to be carried out or before the expiration date of the previously authorized validity.

The fee for issuing and releasing the operating permit/approval/authorization, as well as the annual validation fee, are stipulated in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and duties in the Municipality of Bucharest. These will be paid at the cashier offices of Sector 3 City Hall, and the proof of payment will be submitted along with the authorization documentation.

In accordance with the provisions of art. 475 para. Urbanism - Request for Extension of Building Permit*

For the extension of the validity of the building permit, a standard application (according to Form - model F.12 - APPLICATION for the extension of the validity of the building permit) must be completed and submitted to the issuer, accompanied by the original issued building permit. The application for the extension of the validity of the building permit must be submitted 15 days before the expiration of its validity date.

When submitting the application for the extension of the validity of the building permit, the applicant must provide proof of payment for the extension fee.

Urbanism - Request for Urbanism Certificate*

The applicant for the urbanism certificate is the natural or legal person interested in receiving information from the competent public administration authority regarding a property, land and/or buildings for the purposes defined in art. 6 of the law.

For the issuance of the urbanism certificate, the applicant will contact the City Hall of Sector 3 by submitting a request according to form F.1 - REQUEST for issuing the urbanism certificate, in which both the identification elements of the property for: which the urbanism certificate is requested will be entered: locality, cadastral number and land registry number, where applicable, unless the law provides otherwise, as well as the elements that define the purpose of the request.

- Copy of receipt for payment of the legal fee:

- up to 150 sqm - 5 lei
- between 151 – 250 sqm inclusive – 6 lei
- between 251 – 500 sqm inclusive - 8 lei
- between 501 – 750 sqm inclusive – 10 lei
- between 751 – 1000 sqm inclusive – 14 lei
- over 1,000 sqm – 14+0.01 lei/sqm for surfaces larger than 1,000 sqm

Request for issuance of the operating permit (temporary) for the sale of items specific to the winter/spring holidays*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of Government Ordinance no. 99/2000 regarding the commercialization of products and market services, any commercial activity is carried out only by authorized traders under the conditions of the law, and according to art.6 para.(1) and (2) of the same normative act: trade in public areas is carried out in sales structures with a fixed or mobile location. The conduct of commercialization activities in public areas is subject to the approval of the local public administration authorities or the sectors of the Municipality of Bucharest, as the case may be, in compliance with their own regulations and urban planning plans.

Considering the above-mentioned legal provisions, reported in relation to the provisions of art. 63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulations regarding the conduct of activities for the commercialization of products and market services in the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the agreement/authorization/operating permit by individuals and legal entities that carry out activities for the commercialization of products and market services in public areas or any other type of area intended for public use, in sales structures with a fixed or mobile location, permanent, temporary, or, as the case may be, seasonal, in the territory of Sector 3 of the Municipality of Bucharest.

According to art.2, letter a), the operating agreement is the individual administrative act by which the conditions for carrying out activities of commercialization of products and market services are established, exclusively food service units; letter b) the operating authorization is the individual administrative act by which the conditions for carrying out food service activities are established (restaurant CAEN Code 5610, bar CAEN Code 5630), and according to letter c), the operating permit is the individual administrative act by which the conditions for carrying out activities of commercialization of products and market services, carried out temporarily and/or seasonally, are established.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or will carry out commercial, services, and food service activities, are obliged to submit the documentation for obtaining or extending the validity period of the operating agreement/authorization, at least 30 calendar days before the start date of the activity they intend to carry out or before the expiration date of the initially authorized validity.

The fee for issuing and releasing the operating permit/agreement/authorization, as well as the fee for its annual endorsement, are provided for in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and fees in the Municipality of Bucharest. These will be paid at the cash desks within the Sector 3 City Hall, and the proof of payment will be submitted together with the authorization documentation.

According to the provisions of art. 475 para. (3), (4), and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with subsequent amendments and completions, and the Decisions of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and fees in the Municipality of Bucharest, economic agents who carry out food service activities (CAEN codes 5610, 5630), must pay the public food service tax in full, in advance of the issuance of the authorization, regardless of the period remaining until the end of the respective fiscal year, as follows:

- the fee in the amount of 3,000 lei for the issuance/annual endorsement of the Operating Authorization - public food service (bar, restaurant), for an area of up to 500 m2;
- the fee in the amount of 4,000 lei for the issuance/annual endorsement of the Operating Authorization - public food service (bar, restaurant), for an area greater than 500 m2.

COMMERCIAL AUTHORIZATION PROCEDURE

Considering the above-mentioned legal provisions, reported to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council Sector 3 adopted Decision no. 313/2017 for the varying the Regulation regarding the conduct of product and service market activities in the territory of Sector 3 of the Municipality of Bucharest.

Through the regulation, the procedure for obtaining the agreement/authorization/operating permit by natural and legal persons exercising market product and service trading activities in public areas or in any other area intended for public use, in sales structures with fixed or mobile headquarters, permanent, temporary, or, as the case may be, seasonal, in the territory of Sector 3 of the Municipality of Bucharest, is established.

According to art.2 letter a), the operating agreement is the individual administrative act by which the conditions for conducting market product and service trading activities, excluding public catering units, are established; letter b) the operating authorization is the individual administrative act by which the conditions for conducting public catering activities (restaurant CAEN Code 5610, bar CAEN Code 5630) are established, and according to letter c), the operating permit is the individual administrative act by which the conditions for NB: conducting temporary and/or seasonal market product and service trading activities are established.

According to art.3 from H.C.L.S.3 no. 313/2017: economic agents who carry out or are about to carry out commercial, service, or public catering activities, have the obligation to submit the documentation for obtaining or extending the validity of the operating agreement/authorization, at least 30 calendar days before the starting date of the activity or before the initially authorized validity date expires.

The fee for issuing and releasing the operating permit/agreement/authorization, as well as the fee for its annual endorsement, are provided in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and fees in the Municipality of Bucharest. These will be paid at the cash desks within the City Hall of Sector 3, and proof of payment will be submitted together with the authorization documentation.

In deepest accordance with the provisions of art. 475 para. Considering the above-mentioned legal provisions, reported to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council Sector 3 adopted Decision no. 313/2017 approving the Regulation regarding the conduct of marketing activities of products and market services on the territory of Sector 3 of Bucharest Municipality.

Through the regulation, the procedure is established for obtaining the agreement/authorization/operation endorsement by natural and legal persons, who carry out marketing activities of products and market services in public areas or in any other area intended for public use, in fixed or mobile, permanent, temporary, or, as the case may be, seasonal sales structures on the territory of Sector 3 of Bucharest Municipality.

The regulation establishes the procedure for real persons and legal entities to obtain the approval/authorization/certificate of operation, who conduct goods and market services commercialization activities in public areas or any other type of area destined for public use, in fixed or mobile selling structures, permanent, temporary or, as appropriate, seasonal within Sector 3 of the Municipality of Bucharest.

According to art.2 letter a), operation approval is the individual administrative act establishing the conditions for the conduct of goods and market services commercialization Atlanticities, exclusively for public food units; letter b) operation authorization is the individual administrative act establishing the conditions for the conduct of public food activities (restaurant CAEN code 5610, bar CAEN code 5630), and according to letter c), the operation certificate is the individual administrative act establishing the conditions for the conduct of goods and market services commercialization activities, carried out temporary and/or seasonal.

According to art.3 of H.C.L.S.3 no. 313/2017: economic operators who carry out or are about to start commercial, service providing and public food activities, have the obligation to submit the documentation for obtaining or extending the validity term of the operation approval / authorization, at least 30 calendar days before the date of commencement of the activity to be conducted or before the expiry date of the initially authorized validity.

The fee for issuing and releasing the certificate/approval/operation authorization, as well as the annual visa fee thereof, are provided in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of levels of local taxes and duties in the Municipality of Bucharest. These will be paid at the Sector 3 City Hall cash registers, and proof of payment will be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4), and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with its subsequent modifications and completions, and the Decisions of the General Council of the Municipality of Bucharest regarding the establishment of local tax and fee levels in the Municipality of Bucharest, economic agents carrying out public food activities (CAEN code 5610,5630) must pay the public food tax in full, in advance of the authorization release, regardless of the period remaining until the end of the respective fiscal year, as follows:

- a fee of 3,000 lei for issuance/annual endorsement of the Operation Authorization - public food (bar, restaurant), for an area up to 500 m2;

- a fee of 4,000 lei for issuance/annual endorsement of the Operation Authorization - public food (bar, restaurant), for an area greater than 500 m2.

Urbanism - Request for Extension of Urbanism Certificate*

For the extension of the validity of the urbanism certificate, a standard application form (according to Form - model F.7 - APPLICATION for the extension of the validity of the urbanism certificate) must be filled out and submitted to the issuer, together with the original issued urbanism certificate. The application for extension of validity must be submitted 15 days before the expiry date of the certificate.

When submitting the application for extension of the validity of the urbanism certificate, the applicant must provide proof of payment for the extension fee.

Payment can be made online at https://www.ghiseul.ro or by bank transfer to the account RO 48 TREZ 70321160203XXXXX, C.U.I-P.S.3-4420465, via TREZORERIA SECTOR 3.
The structure handling the application is the Urbanism Department.
