Procedure for certifying a maternal assistant*
The maternal assistant is the natural person, certified under the conditions of Law no. 323/2024 for the approval of Ordinance no. 27/2024 regarding the conditions for obtaining the certificate, the certification procedure, and the status of the maternal assistant, an employee of the General Directorate of Social Assistance and Child Protection Mehedinti, who provides, through their activity carried out at their own home/residence, the upbringing, care, and education of the child during the application of the special protection measure of placement/placement in emergency regime for the child temporarily or permanently separated from their parents or, as the case may be, during the re-placing period by another maternal assistant.
a. Necessary conditions to become a maternal assistant
The person who wishes to become a maternal assistant must cumulatively fulfill the following conditions:
1. to have domicile in Mehedinti county;
2. to have graduated from vocational or high school education;
3. is at least 21 years old;
4. their behavior in society and their psychological profile provide moral guarantees regarding the upbringing, care, and education of children
5. the person and their spouse present emotional availability in relations with children, confirmed following psychological evaluation;
6. the spouse and children who have reached the age of 14 and who have the same domicile, or as the case may be, the same residence with the applicant, express their consent regarding the reception of a child/children in the family;
7. has domicile or, as the case may be, residence in a locality with access to educational and medical services for the child/children they will receive in placement and, as necessary, access to habilitation/rehabilitation services for the child with disabilities;
8. has usage slap rights over a dwelling that properly covers the necessities of food preparation, hygiene, education, and rest for its users, including for children to be received in placement, for whom an individualized rest space and a place for homework can be ensured;
9. at least one of the adult members of the family earns income, except the maternal assistant, if living with one or more members
10. has not exceeded the standard retirement age provided by Law no. 360/2023 regarding the public pension system;
11. has not suffered a conviction through a final court decision for intentionally committing an offense against a person, against authority, against the administration of justice, for corruption and service-related offenses, as well as for drug trafficking offenses, relating to the regime of doping substances, performing illegal operations with precursors or other products likely to have psychoactive effects, or is registered with mentions in the national automated registry regarding persons who have committed sexual offenses, exploitation of persons or minors;
12. has no family members aged 14 or older or other persons living with them who have been convicted by a final court decision for an offense among those specified in lit.b) or are registered with mentions in the national automated registry regarding persons who have committed sexual offenses, exploitation of persons or minors;
14. does not suffer from transmissible diseases that could endanger the health of the child;
15. does not have family members or other adults living with him/her who suffer from under communicable diseases that could endanger the health of the child;
16. does not have a history of violence for 'protective order' for whom a provisional order, or, as the case may be, protection order was issued, according to Law no. 217/2003 for preventing and combating domestic violence, republished, with subsequent amendments and completions, or according to Law no.26/2024 regarding the protection thes order, nor have family members or other adults living with him/her for whom the mentioned orders have been issued;
17. has not had or, as the case may be, does not have one or more natural children in the special protection system;
18. has not consented to the adoption of pipeline own child, except for the situation where the child was adopted by the spouse;
19. does not suffer from psychiatric illnesses, and is not addicted to alcohol, drugs, or other psychotropic substances;
20. does not have family members or other adults living with him/her who suffer from psychiatric illnesses, are dependent on alcohol, drugs, or other psychotropic substances;
21. has not had their certificate as a professional maternal assistant revoked, except in situations where it was revoked upon request.
Necessary documents
The person wishing to become a maternal assistant addresses an application for evaluation to the management of DGASPC Mehedinti.
The following documents must be obligatorily attached to the evaluation application:
a) curriculum vitae of the applicant;
b) a copy, certified by the directorate, or as the case may be, by the applicant, of the applicant's identity card, long-term residence permit, or, as appropriate, permanent residence card and, as the case may be, for each person with inline he/she lives;
c) certified copy by the directorate, or as appropriate, by the applicant, of the applicant's birth certificate and, as the case may be, for each person with him/her lives;
d) certified copy by the directorate, or as the case may be, by the applicant, of the marriage certificate or the divorce decision/divorce certificate, if applicable;
e) certified copy by the directorate, or as the case may be, by the applicant, of their education diploma;
f) certified copy by the directorate, or as applicable, by the applicant, of the property's title or any other document attesting the right to use the dwelling;
g) criminal record certificate of the applicant and, as applicable, of each person who has reached the age of 14 with whom they live;
h) behavioral integrity certificate of the applicant and, as the case may be, of each adult living with him/her;
i) income certificate or other documents certifying the applicant's income or, as the case may be, at least one of the adult family members with whom he/she lives;
j) certificate issued by the family doctor regarding the health status of the applicant, specifying that they do not suffer from contagious diseases and, as the case may be, of each adult living with him/her;
k) medical certificate issued by a specialist doctor stating that the applicant, or as applicable, the adults he/she lives with do not suffer from mental illnesses;
l) authentic self-declaration from which it results that the applicant is not in one of the following situations:
- has not been deprived of parental rights by a final court decision nor forbidden to exercise parental rights as a complementary punishment;
- has not had or, as the case may be, does not have one or more natural children in the special protection system;
- has not consented to the adoption of his/her own child, except if the child was adopted by the husband;
- has not been revoked the certificate of professional maternal assistant, except in situations where the certificate was revoked at request.
m) recommendations from the applicant’s neighbors, relatives, other community members/persons from his/her social circle, or, as applicable, from local public administration authorities, regarding the applicant’s social behavior and, as the case may be, the family members living with him/her;
The evaluation application is resolved within 90 calendar days from the date of proper registration with the directorate.
After the social and psychological evaluation, in preparation for the exercise of the activity of maternal assistant, the applicant participates in professional training courses, according to a curriculum developed by the National Authority for the Protection of the Rights of under Children and Adoption, in collaboration with representatives of the academic environment, which will last 80 hours, of which 50 hours theory and 30 hours practice.
Professional training of maternal assistants is carried out by the directorates, as authorized training providers under Government Ordinance no.129/2000 regarding adult professional training, republished, with subsequent amendments and completions.
Certification
The applicant who has received the Final Evaluation Report of the applicant’s capacity to become a maternal assistant, with a proposal to issue the certificate, submits, at the office of the directorate from their domicile or residence, as the case may be, an application addressed to CPC Mehedinti by which he/she requests the issuance of the certificate of maternal assistant, which is resolved within 30 days from the date of registration with the directorate.
Throughout the evaluation process, the person requesting the certificate of maternal assistant is obliged to inform the members of the evaluation team about any changes concerning the fulfillment of one or more of the necessary conditions to become a maternal assistant, provided in this procedure, annexing, as the case may be, supporting documents.
CPC Mehedinti, after analyzing the Final Evaluation Report of the applicant’s capacity to become a maternal assistant and hearing the applicant, presented by one of the members of the evaluation team, pronounces a motivated decision regarding the admission or, as the case may be, rejection of the request for issuing the certificate of maternal assistantl. The certificate is annexed to the CPC decision.
CPC may, in justified situations, also hear other persons from whom they may request additional information deemed necessary for the admission or, as the case may be, the rejection of the request for issuing the certificate of maternal assistant. The certificate of maternal assistant is issued for an indefinite period and is reviewed every two years.
