This procedure regulates the manner of organizing the activity of receiving citizens in audience at the Bistrița-Năsăud County Council.

Request for issuance of certificate requested by former employees of the Bistrița-Năsăud County Council within 3 years from the termination of the employment relationship/individual employment contract*
This procedure regulates the way online requests are submitted by individuals whose mandate/service relationship/individual employment contract/management contract with the local public authority - Bistrița-Năsăud County Council ended 3 years ago, for the purpose of issuing the requested certificates attesting a right or a fact, respectively the period of activity carried out within the authority, the duration of the activity, work seniority, seniority in the field of studies, seniority in professional grade, and monthly salary.
Clarifications
According to art. 7 para.(6) of Government Decision no. 905/2017 regarding the general register of employee records, the settlement term is:
”(6) At the written request of the employee or a former employee, employers are obliged to issue an extract from the register, dated and certified as true, or a certificate attesting the activity carried out by the individual, the duration of the activity, salary, work and specialty seniority, as it appears from the register and the personal file, within a maximum of 15 days from the date of the request.”
The same settlement term will be applied in the case of persons who were appointed to public positions during their service relationship within the Bistrița-Năsăud County Council, based on the provisions of art. 367 of the Government Emergency Ordinance no. 57/2019 regarding the Administrative Code, with subsequent amendments and completions.
Type of electronic signature
A qualified electronic signature is understood as an advanced electronic signature that is created by a qualified electronic signature creation device and that is based on a qualified certificate for electronic signatures according to the definitions provided in art.3 of EU Regulation no. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC. The type of electronic signature applicable by individuals or legal entities for requests sent online through the PCUe platform is the qualified electronic signature. If the applicant does not possess a qualified electronic signature, the request will be sent in original by post or submitted directly to the registry of the Bistrița-Năsăud County Council.

Request for issuance of certificate from the archive of the Bistrița-Năsăud County Council*
This procedure regulates the method for submitting online requests for issuing a certificate from the archive of the Bistrița-Năsăud County Council, in accordance with the provisions of art. 29 of the National Archives Law no.16/1996, republished, art.44 of the Instructions regarding the archival activity at document creators and holders, approved by the leadership of the National Archives through Day Order no. 217/1996, and art.3 of Government Ordinance no. 33/2002 on regulating the issuance of certificates and attestations by central and local public authorities.
Notes
The resolution deadline according to Art.8 para(1) of Government Ordinance no.27/2002 on regulating the activity of resolving petitions, with subsequent amendments and completions is: “The public authorities and institutions notified are required to communicate to the petitioner, within 30 days from the date of registration of the petition, the response, whether the solution is favorable or unfavorable."

Request for information of public interest according to the provisions of Law no. 544/2001 regarding free access to information of public interest*
This procedure regulates the way of submitting online requests for public interest information, according to the provisions of Law no. 544/2001 regarding the free access to public interest information, within the Bistrița-Năsăud County Council.
Clarifications:
The deadlines for solving, according to Law no. 544/2001 regarding the free access to public interest information, are found in ART.7:
"(1) Public authorities and institutions are obliged to respond in writing to requests for public interest information within 10 days or, as the case may be, in no more than 30 days from the registration of the request, depending on the difficulty, complexity, volume of documentary work, and urgency of the request. If the time needed to identify and provide the requested information exceeds 10 days, the answer will be communicated to the applicant within a maximum of 30 days, provided that the applicant is notified in writing about this fact within 10 days.
(2) The refusal to communicate the requested information must be justified and communicated within 5 days from the receipt of the petitions.
The costs related to the copying services of requested documents (if copies in written format are requested) can be paid: in cash, by bank transfer, by bank card, and through other payment systems, according to the legal provisions in force. The multiplication fee set according to the Decision of the Bistrița-Năsăud County Council no. 148 from 19.12.2019 regarding the fees for identifying and releasing copies of documents created and managed by the Bistrița-Năsăud County Council for the year 2020 is as follows:

- Simple copy of the documents created and managed by the institution:
A4 format - 1 leu/page;
A3 format - 2 lei/page;
- Certified copies with the inscription "certified copy of the original" after the documents created and managed by the institution
A4 format - 2 lei/page;
A3 format - 3 lei/page;
The fees for copying other documents that require larger sizes will be calculated on the basis of the A4 format, compared to which the multiplied surface area of the A4 format will be calculated and charged.

Petition submission*
This procedure regulates the online submission of petitions addressed to the Bistrița-Năsăud County Council, according to the provisions of Government Ordinance no. 27/2002 regarding the regulation of the activity for solving petitions, with subsequent amendments and completions.
By petition is understood the request, complaint, notification, or proposal formulated in writing or by electronic mail, which a citizen or a legally constituted organization can address to central and local public authorities and institutions, decentralized public services of ministries and other central bodies, national companies and corporations, commercial companies of county or local interest, as well as autonomous administrations, hereinafter referred to as public authorities and institutions according to art.2 of Government Ordinance no. 27/2002 regarding the regulation of the activity for solving petitions, with subsequent amendments and completions.
Clarifications:
The resolution deadlines according to art.8 and art.9 of Government Ordinance no. 27/2002 regarding the regulation of the activity for solving petitions, approved by Law no. 233/2002, with subsequent amendments, are:
“Art.8 (1) The public authorities and institutions notified are obliged to communicate to the petitioner, within 30 days from the date of registration of the petition, the response, regardless of whether the solution is favorable or unfavorable.
(2) For solving petitions transmitted, according to art. 6^1, from other public authorities or institutions, the 30-day term runs from the date of registration of the petition at the competent public authority or institution.
Art.9 In the situation where the aspects notified by petition require more thorough information and investigation, the head of the public authority or institution may extend the term provided for in art. 8 by a maximum of 15 days, and in the field of energy and natural gas, the term may be extended by a maximum of 30 days, with prior notification of the petitioner.”

Request regarding the completion of the internship within the undergraduate or master's degree study programs*
This procedure regulates the way of submitting online applications regarding the performance of the internship within bachelor’s or master’s degree programs according to Order no. 3955/2008 of the Ministry of Education, Research and Youth regarding the approval of the General Framework for organizing internships within bachelor’s and master’s degree programs and the Standard Agreement regarding the performance of the internship within bachelor’s or master’s degree programs, within the Bistrița-Năsăud County Council.

The settlement deadlines according to art. 8 para. (1) and art. 9 of the Government Ordinance no. 27/2002 regarding the regulation of the activity of settling petitions, amended and supplemented by Law no. 233/2002 for the approval of Government Ordinance no. 27/2002 regarding the regulation of the activity of settling petitions are: “art.8(1) The notified authorities and public institutions are obliged to communicate to the petitioner, within 30 days from the date of registration of the petition, the answer, regardless of whether the solution is favorable or unfavorable. art.9 If the issues raised by the petition require a more thorough investigation, the head of the authority or public institution may extend the deadline provided in art. 8 by no more than 15 days."

Submission of recommendations according to Law no.52/2003*
This procedure regulates the manner of submitting proposals/suggestions/opinions with a recommendatory character regarding the normative acts subject to public consultation, by using the online services within the "Single Electronic Contact Point" (PCUe) platform of the National Electronic System for e-government.
Clarifications
In accordance with the provisions of art.7 para.(1) of Law no.52/2003, within the procedures for drafting normative act projects, the Bistrița-Năsăud County Council is obliged to publish an announcement regarding this action on its own website, display it at its own headquarters in an area accessible to the public, and send it to the local media, as appropriate.
Upon publication of the announcement, a period of at least 10 calendar days is set to receive proposals, suggestions, or opinions regarding the normative act projects subject to public consultation.
The proposal, suggestion, or opinion (hereinafter referred to as recommendation) regarding the normative act project subject to public debate is recorded in a register, stating the date of receipt, the person, and the contact details from whom the recommendation was received.
Interested persons/organizations that submit recommendations regarding the normative act project subject to public debate must specify the article or articles of the normative act project to which they refer, stating the date of submission and the contact details of the sender.

Request for issuance of copies of documents held in the archive of the Bistrița-Năsăud County Council*
This procedure regulates the method of online submission of applications for the issuance of copies of documents held in the archive of the Bistrița-Năsăud County Council, according to the provisions of art. 29 of the National Archives Law no. 16/1996, republished and art. 44 of the Instructions regarding the archive activity at the creators and holders of documents, approved by the management of the National Archives through Daily Order no. 217/1996.
Resolution Time according to Art. 8 para. (1) of Government Ordinance no. 27/2002 regarding the regulation of the activity of resolving petitions, with subsequent amendments and completions is: "The authorities and public institutions notified are obliged to communicate to the petitioner, within 30 days from the registration of the petition, the response, regardless of whether the solution is favorable or unfavorable."

The costs related to the services of copying the requested documents (if written copies are requested) can be made: in cash, by bank payment, by bank cards, and by other payment systems, according to the legal provisions in force. The duplication fee set according to the Decision of the Bistrița-Năsăud County Council no. 148 from 19.12.2019 regarding the rates for identifying and issuing copies of documents created and managed by the Bistrița-Năsăud County Council, for the year 2020, is as follows:
- Simple copy of documents created and managed by the institution:
- A4 format - 1 leu/page;
- A3 format - 2 lei/page;
- Certified copies with the inscription "certified true copy" affixed to documents created and managed by the institution
- A4 format - 2 lei/page;
- A3 format - 3 lei/page;
The rates for duplication by copier of other documents that require larger sizes will be based on the A4 format; the multiplied area of the A4 format will be calculated and collected.
