This procedure regulates the procedure for issuing the urbanism certificate for construction/demolition/PUZ, PUD elaboration within the Cruset commune City Hall.

Remarks

Art. 19, para. (2) of the Methodological Norms for the application of Law no.50/1991, approved by MDRL Order no. 839/2009 establish that the urbanism certificate is an informational document regarding the legal, economic, and technical regime of the property, as well as the specific urban requirements of the site, determined in accordance with the provisions of the approved and endorsed urban plans, a document that is issued, upon request, to any applicant – natural person or legal entity – without the need to present a property title over the property or another document attesting the ownership right.

The issuer is prohibited from conditioning the issuance of the urbanism certificate on the prior preparation of an urban planning documentation for the property in question, as well as of any other technical documentation defining the purpose of the request.

Under these conditions, for the purpose of detailing the proposed urban intervention, other documents prepared by a designer may also be attached to the mandatory legal documentation, consisting of plans on cadastral support with the situation of existing and proposed constructions, and a technical report detailing the proposals in the plans, with an estimate of the impact of the proposed works on the neighborhood; These plans are optional and serve exclusively as information regarding the investor's intentions, and cannot be endorsed as unchangeable.

The plans to be endorsed as unchangeable shall be the cadastral plan extracts on the orthophotoplan or other plans issued/endorsed by the Gorj Office for Cadastre and Real Estate Publicity, highlighting the cadastral parcels for which the urbanism certificate is requested.

For properties registered in the cadastre and real estate publicity records, plans for area location at one of the scales 1:10,000, 1:5,000, 1:2,000, 1:1,000, 1:500, as applicable, issued, upon request, by the office for cadastre and real estate publicity (OCPI), highlighting the cadastral parcels for which the urbanism certificate is requested, but containing no proposals regarding construction interventions at parcel level, can be endorsed as unchangeable annexed to the urbanism certificate. These endorsed plans may be used within the documentation required for obtaining endorsements requested by the urbanism certificate.

The boards containing intervention proposals, requested by the institutions empowered to issue the necessary endorsements, will be drawn up on the topographic support endorsed by OCPI in order to be used for obtaining the building permit, together with the plans endorsed as unchangeable annexed to the urbanism certificate, mentioned in the previous paragraph.

In accordance with para. 23^1, para. 23^2, para. 23^3 of art. 7 of Law no. 50/1991 regarding the authorization of construction works, the beneficiary is obliged to present:
- the land register excerpt showing the entry of the building permit;
- the announcement made public in a widely circulated newspaper regarding the issued building permit.
Regarding the public nature, the content of the building permit will be subject to examination at the headquarters of the public authority issuing the act. (according to para. 23^5 art. 7 of Law 50/1991 regarding the authorization of construction works).
