This procedure regulates the manner of extension of the placement and/or access authorization in the public road area, in the case of advertising means, the beneficiary shall submit the extension request 30 days before its expiration.

Art.46*) - (1) For the placement or installation in the public road area of advertising boards, any constructions or commercial activities, access ways, arrangements or installations for any purpose, without endangering traffic safety, are mandatory, besides the building permit, as the case may be, the prior agreement and the placement and/or access authorization in the public road area, issued by the administrator of the respective road.

Art.46*) - (1) For the execution or placement in project of advertising boards, any constructions or commercial activities, access roads, arrangements or installations for any purpose in the area of the public road, without endangering traffic safety, in addition to the building permit, as applicable, the prior agreement and the placement and/or access authorization in the area of the public road, issued by the administrator of the respective road, are mandatory.

Art.46*) - (3) The obligation and responsibility for requesting the prior agreement and the placement and/or access authorization in the area of the public road, as well as for complying with them, lie with the beneficiary of the works or objectives executed or placed in the public road area.

This procedure regulates the manner in which the Mureș County Council issues the prior approval for carrying out works in the area of county roads in Mureș County, under the administration of the Mureș County Council, in accordance with the provisions of Government Ordinance no.43/1997 regarding the regime of roads, republished, with subsequent amendments and completions.

ART. 6

(1) The urbanism certificate is the informing document by which the authorities provided for in art. 4 and art. 43 letter a):

a) make known to the applicant the information regarding the legal, economic and technical status of the lands and the constructions existing at the time of the request, in accordance with the provisions of the urban plans and their related regulations or the territorial planning plans, as the case may be, endorsed and approved according to the law;

b) establish the urban requirements that are to be fulfilled depending on the specifics of the location;

c) establish the list including the approvals/agreements necessary for authorizing the execution of construction works;

c^1) nominally indicate the operators of technical-utility networks who will issue the respective approvals/agreements; approvals will only be requested from the holders of above-ground and underground networks that affect the land area and/or the constructions for which urbanism certificates are requested, with the consultation of the urban database constituted under the conditions of the law;

d) inform the investor/applicant regarding the obligation to contact the competent environmental protection authority, in order to obtain its opinion and, as the case may be, its administrative act, necessary for authorization.

This procedure describes the way the activity of issuing the Chief Architect’s Opinion for the urbanism certificate is managed

ART. 6

(1) The urbanism certificate is the informative document by which the authorities provided for in art. 4 and art. 43 letter a):

a) inform the applicant about the legal, economic, and technical status of the land and existing constructions at the time of the request, in accordance with the provisions of the urban plans and their related regulations or territorial planning documents, as applicable, endorsed and approved according to the law;

b) establish the urbanistic requirements to be fulfilled depending on the specifics of the location;

c) establish the list including the approvals/agreements necessary for the authorization of construction works;

c^1) indicate by name the technical-utility network operators who will issue the respective approvals/agreements; approvals will only be requested from the owners of overground and underground networks that affect the land area and/or constructions for which the urbanism certificates are requested, by consulting the urban database established under the law;

d) inform the investor/applicant about the obligation to contact the competent environmental protection authority, in order to obtain its point of view and, if necessary, its administrative document, required for authorization purposes.

This procedure regulates the online submission method of the administrative complaint as a result of the fact that, upon requesting information of public interest from the Mureș County Council, according to the provisions of Law 544/2001 regarding free access to information of public interest, the applicant did not receive the information within the legal term.

Art. 32 - If a person considers that the right regarding access to information of public interest has been violated, they may submit an administrative complaint to the head of the authority or public institution to which the information was requested.

Art. 33 – The person who considers themselves harmed in their rights may submit the administrative complaint provided in art. 32 within 30 days from becoming aware of the explicit or tacit refusal of the employees of the authority or public institution to apply the provisions of the law and these norms.

Procedure Description:

This procedure describes how the activity of verifying the content of the submitted documentation, technical examination and endorsement of the documentation, drafting/signing/registration/issuance of the building/demolition permit is managed, according to the provisions of Law no.50/1991 regarding the authorization of construction works, republished, with subsequent amendments and completions.

Art.1

(1) The execution of construction works is allowed only based on a building or demolition permit, issued under the conditions of this law, at the request of the holder of a real right over an immovable property - land and/or buildings - identified by cadastral number, unless the law provides otherwise.

Art.2

(1) The building permit constitutes the final act of authority of the local public administration on the basis of which the execution of construction works is allowed according to the measures provided by law regarding the location, design, realization, operation and post-use of constructions.

Clarifications: Resolution deadlines - according to Law no.544/2001 regarding free access to public interest information are found in Article 7:

"(1) Public authorities and institutions are obligated to respond in writing to requests for public interest information within 10 days or, as the case may be, within no more than 30 days from the registration of the request, depending on the difficulty, complexity, volume of documentary work, and urgency of the request. If the time required to identify and disseminate the requested information exceeds 10 days, the response shall be communicated to the applicant within a maximum of 30 days, provided the applicant is notified in writing about this fact within 10 days.

The fees for copying other documents, which require larger sizes, will be calculated based on the A4 format (the multiplied area of the A4 format).

This procedure regulates the method of submitting the administrative complaint online as a result of the fact that, upon request for obtaining information of public interest addressed to Mureș County Council, according to the provisions of Law 544/2001 regarding free access to information of public interest, the applicant received a negative response.

Art. 32 - In case a person considers that the right regarding access to information of public interest has been violated, he or she may address an administrative complaint to the head of the authority or public institution to which the information was requested.

ART. 6

(1) The urban planning certificate is the informational document by which the authorities provided for in art. 4 and art. 43 letter a):

a) make available to the applicant information regarding the legal, economic, and technical status of the lands and existing constructions at the date of the request, in accordance with the provisions of urban plans and their associated regulations or, as the case may be, territorial management plans, approved and endorsed according to the law;

b) establish urban requirements to be met according to the specifics of the location;

c) establish the list of necessary approvals/agreements for authorizing the execution of construction works;

c^1) indicate by name the utility network operators who will issue these approvals/agreements; approvals shall be requested only from the owners of aboveground and underground networks that affect the land and/or constructions for which urban planning certificates are requested, with the consultation of the urban database established according to the law;

d) inform the investor/applicant regarding the obligation to contact the competent authority for environmental protection, in order to obtain its point of view and, as the case may be, its administrative act, necessary for authorization.
