Obtaining the location permit requested in the Urbanism Certificate consists of going through the following steps:

1. Submitting the request and the related documentation to the society's Territorial Operation (jurisdiction for resolution is determined according to the place where the future construction will be executed - see here list of all Territorial Operations)

- Note: If the request is addressed incorrectly, it will be redirected to the competent Territorial Operation for resolution.

2. Registration of the request at the Territorial Operation.

3. Verification of documentation and request for additions, if necessary;

4. Communication of the fee for the type of permit requested; issuing the invoice and/or receipt;

If the applicant does not express acceptance and does not make the payment, the submitted request cannot be further processed, the request will be closed.

5. Allocating necessary resources and scheduling the trip; traveling to and from the designated place by the OTS technical team, for identifying and verifying in the field of the location for which the permit is requested; and ST objectives;

6. Elaboration of opinion regarding the documentation through – marking ST objectives on the structure of the location plan, specifying GPS coordinates and endorsing the location plan.

NOTE: After this stage, the documentation as a whole will be considered complete; The complete documentation will be assigned a registration number.

7. The complete documentation will be analyzed and the location permit will be issued by the competent structure as follows:

1. For works located outside the safety zone, (>200 m) Territorial Operation analyzes the entire documentation and issues the location permit.

2. For works within the safety zone (<200 m), Territorial Operation will redirect the complete documentation for analysis and approval at the central headquarters in Medias- D.E.M. – serv. A.C.P.C.,

8. Sending the permit to the applicant.

Maximum deadlines for issuing the permit, according to the provisions of Law no. 50/1991 and Order no. 47/1203/509/2003 are:

- For technical-utility networks the maximum term is 5 working days – calculated from the date of registration of the complete documentation at the structure competent for resolution. (see item 7 a or 7 b)

- 15 working days calculated from the date of registration of the complete documentation at the structure competent for resolution. (see item 7 a or 7 b)

By complete documentation is meant the initial documentation submitted by the applicant, (with additions if necessary), to which is added

- proof of payment of the fee, (see item 4)

- the opinion from the Territorial Operation, accompanied by a plan with the ST objectives marked (see item 6)

During the period in which the applicant must provide clarifications or make payment, the deadlines do not run, the request is stopped.

If the applicant does not express acceptance or does not make the payment, the submitted request cannot be further processed. the request will be closed.

The permit can be favorable, conditional or unfavorable.

Will be issued:

- a favorable permit, if when locating the future construction the minimum safety distances provided in ANRE Order no. 118/2013 regarding the approval of technical rules for the design and execution of natural gas transport pipelines are respected.

- an unfavorable permit, if when locating the future construction the minimum safety distances provided in ANRE Order no. 118/2013 regarding the approval of technical rules for the design and execution of natural gas transport pipelines are not respected. In case of the unfavorable permit, the reasons for prohibition of the construction or work in the ST safety zone will be specified, as well as the way in which a favorable permit can be obtained (relocating the construction or, if possible, diversion of SNT objectives, at one's own expense)

- a conditional permit, if the minimum safety distances are respected, but it is necessary to establish specific technical conditions, by which the applicant is notified to meet the technical conditions, at their own expense, prior to carrying out the construction. Failure to meet these conditions will void the permit.

In the context of article 476 of Law no. 227/08.09.2015 regarding the Fiscal Code, with subsequent changes and additions ARE EXEMPT from paying the fee for issuing permits the following categories of persons/institutions/works:

- war veterans, war widows or unmarried widows of war veterans;

- persons provided in art. 1 of Decree-law no. 118/1990, republished, with subsequent changes and additions;

- places of worship or annex constructions;

- modernization or rehabilitation of infrastructures from transport belonging to the state's public domain;

- works of national, county or local public interest;

- public institutions
