The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, as the case may be, the social benefits due and unpaid until the death shall be paid to the surviving spouse, children, parents or, in their absence, to the other heirs, under the conditions of common law, at their request. The amounts mentioned above may be requested at the territorial agency for payments and social inspection by the heir within the general prescription period, based on the document attesting the status of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not claim these amounts.
