According to the provisions of the Government Ordinance no. 27/2011 on road transport, drivers engaged in the carriage of goods or passengers by road, holding a category D1, D1E, D or DE license, and respectively, C1, C1E, C or CE license, must be the holders of a CPC certifying the initial qualification (CPI) or a CPC certifying the periodic training (CPC), as the case may be. The Government Ordinance no. 27/2011 and the Minister of Transports Order no. 1214/2015, also stipulate that, the only valid certificates recognized in Romania are the CPI and CPC issued by other member states according to the provisions of Directive 2003/59/CE, as further amended and completed. Accordingly, as provided for in the before mentioned Directive, in order to check if a driver meets the requirements, member states shall issue him/her a certificate of professional competence, hereinafter called CPC, certifying the initial qualification or the periodical training. It is also stipulated that member states may affix the Community Code established by the Directive 91/439/CEE either to the driving license, together with the expiry date of the qualifications, alongside the categories for which the initial qualification or the periodical training are certified, or to the driver qualification card. The Driver Qualification Card issued by the EU member states is mutually recognized by the member states. In order to recognize in Romania the CPC certifying the initial qualification or the periodic training of the EU nationals, which allows the holders to undertake road transport activities using vehicles for which a driving license for category D1, D1E, D or DE and, respectively, C1, C1E, C or CE is required, the applicants shall submit an application form, a two-sided copy of the CPC and the driving license in copy (for those having marked the Community Code on their driving license. The Community Code certifies, given the Directive 91/439/CEE, that the respective driver is the holder of a CPC and meets the requirement of professional competence as provided for in the Directive 2003/59/CE, until the expiry date alongside the category license). The Romanian Road Transport Authority - ARR shall contact the issuing authority of the EU member states, in order to check the authenticity and validity of the documents attached (driving license and CPC) and, according to its answer, shall notify the applicant. Please, note that the sooner the issuing authority of the CPC/driving license answers, the sooner the applicant shall be notified. Any person who considers himself harmed in its right or a legitimate interest by a public authority through administrative acts or failure to resolve a claim, have the right to appeal the Administrative Court, according to the Law 544/2004 on administrative contentious, as further amended and completed.
