The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or complementary budget for the month in which the death occurred, and, if applicable, the social benefits due and unpaid until the date of death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, under the conditions of common law, upon their request. The amounts mentioned above may be requested from the territorial agency for payments and social inspection by the heir, within the general statute of limitations, based on the document certifying the status of heir, and, if there are multiple heirs, a declaration on their own responsibility that the other heirs are not requesting these amounts.
