The state allowance for children is granted to all children up to the age of 18, without discrimination. The state allowance for children is also granted to young people who have turned 18 years old and are attending high school or vocational education courses, organized under the law, until their completion, except for those who repeat the school year, except for those who repeat due to health reasons, proven with a medical certificate.

If the parents had the status of migrant workers, they will submit supporting documents attesting to the address (address of the INS–the Institution that pays the allowance in the country/locality within the EU member state) and the insurance number from the EU member state where the child was born, as well as a declaration attesting to the period during which they worked, whether they are receiving or have received allowances from that state, and where they currently reside. If the parents did not work abroad and no documents were drawn up for them in the EU member state, the applicant shall submit a declaration specifying the period spent abroad, that they did not receive an allowance from that state, and where they currently reside.*

For the legal representatives requesting the establishment of the right to state allowance, according to Law 61/1993 (republished), and whose children are born in one of the member states of the European Union or whose children have lived together with their parents for a certain period in one of these member states, Annex No. 1 to Council Regulation No. 1408/1971 must also be completed and mandatorily attached to the allowance file. Also, persons who have had or have residency in one of the member states of the European Union will also present residency documents, in copy.*
